Why Disappearing With Unpaid OPay, MoniePoint Loans May Not Work

For some digital borrowers in Nigeria, abandoning a telephone number or deleting a loan application may appear to offer a way out of an outstanding debt. In reality, neither action automatically cancels a loan or removes the borrower’s repayment obligations.

As digital lending continues to expand, identity verification, credit reporting and electronic repayment arrangements are making it increasingly important for borrowers to understand the financial consequences of default.

For customers using platforms such as OPay, Moniepoint and other digital lending services, the implications extend beyond repeated repayment reminders to the possibility of a negative credit record and reduced access to future credit.

Here are some important things borrowers should know.

BVN, NIN and Identity VerificationThe Bank Verification Number (BVN) is an important component of identity verification within Nigeria’s banking system, while the National Identification Number (NIN) serves a broader identification purpose.

These systems can help financial institutions establish a customer’s identity beyond a particular telephone number.

Consequently, changing a registered SIM card does not, by itself, extinguish an outstanding loan or remove the contractual obligations associated with it.

However, the use of BVN and NIN information does not give every lender unrestricted access to a borrower’s financial records or other personal information. Such access remains subject to applicable laws, regulations and legitimate purposes.

Borrowers should therefore understand that changing contact details is not a substitute for settling a debt or reaching an agreement with the lender.

…Understanding Automatic Repayments and Deductions

Some digital loan products provide for electronic repayments through an authorised account, card or wallet. The arrangements depend on the lender’s terms and the permissions granted by the borrower.

Where a customer has authorised a repayment mandate, the lender may be able to initiate deductions in accordance with that arrangement.

However, an outstanding loan does not automatically give a lender unlimited authority to withdraw money from every account belonging to the borrower.

Mechanisms such as direct debits and the banking industry’s Global Standing Instruction (GSI) operate under applicable rules and conditions. Whether a particular mechanism can be used to recover a specific loan depends on the facility, the relevant authorisation and the governing requirements.

Borrowers should review their loan agreements carefully to understand the repayment methods, applicable charges and circumstances under which deductions may occur.

Where a deduction appears unauthorised, they should request an explanation from the lender and pursue a complaint through the appropriate channels if necessary.

…How Default Can Affect Your Credit History

An unpaid digital loan may also affect a borrower’s future access to credit.

Credit bureaux, including CRC Credit Bureau and FirstCentral, provide services that enable lenders to assess credit histories and repayment records.

Where a lender reports a default in accordance with applicable requirements, the information may be considered when the borrower subsequently applies for a loan or another credit facility.

A negative credit record could make it more difficult to obtain financing for a business, purchase a device on credit or secure other forms of borrowing. The effect will depend on the information recorded and the assessment policies of the prospective lender.

Default does not automatically mean a borrower will be permanently excluded from the financial system. Nevertheless, a poor repayment history can influence credit decisions and may limit available options.

Borrowers should also know that they can challenge inaccurate credit information through the relevant lender and credit bureau.Debt Recovery and Consumer Protection

The recovery of unpaid loans must be distinguished from harassment, intimidation and the improper disclosure of personal information.

Nigeria’s Federal Competition and Consumer Protection Commission (FCCPC) has introduced regulatory measures addressing consumer protection and prohibited practices in the digital lending market. Data protection requirements also govern how lenders and recovery agents handle borrowers’ personal information.

Lenders may pursue legitimate repayment demands through appropriate channels, including contacting borrowers and seeking to recover outstanding balances in accordance with applicable law.

However, the existence of a debt does not give a lender unrestricted authority to threaten a borrower, disclose confidential information improperly or employ unlawful recovery methods.

Borrowers who experience abusive collection practices should preserve relevant messages, call records and other evidence and report the matter to the appropriate authority.

Similarly, borrowers who dispute the amount owed should request a breakdown of the principal, interest, fees and other charges forming the outstanding balance.

…What Happens When a Borrower Cannot Repay?

Financial difficulties can make it difficult for customers to meet their repayment obligations. In such circumstances, contacting the lender early may help establish whether a mutually acceptable arrangement is possible.Depending on the lender’s policies, a borrower may be able to negotiate an extension, a revised repayment schedule or a restructuring arrangement. Such options are not guaranteed, and any revised terms should be confirmed in writing.

Ignoring repayment demands does not resolve the underlying obligation. It may instead prolong the dispute and leave the borrower uncertain about the outstanding balance and available options.

Borrowers should also be cautious about taking additional loans to settle existing debts without considering the cost and their ability to meet the new repayment obligations.

…A More Informed Approach to Digital Borrowing

Digital lending offers convenient access to credit, but borrowers need to understand the obligations that accompany that convenience. Before accepting a loan, customers should establish the identity of the lender, examine the repayment terms, confirm the total amount due and understand the consequences of missing a deadline.

They should also review any repayment mandates and permissions requested by the lending application.

For customers who already have outstanding loans, the essential point is that abandoning a telephone number or deleting an application does not automatically cancel the debt.

A lender may continue to pursue repayment through lawful means, while a properly reported default may affect future credit assessments. At the same time, borrowers retain their rights to fair treatment, appropriate handling of personal information and protection against unlawful collection practices.

In Nigeria’s increasingly digital financial environment, understanding both repayment responsibilities and consumer rights is essential to making informed borrowing decisions.
