Florida Woman Attacks Boyfriend, Charges at His Mom’s Car, Then Kicks Police Vehicle Roof, Police Say

A Florida woman attacked her boyfriend after reportedly drinking an entire bottle of wine, then ran toward his mother’s car before falling on a gravel driveway, deputies say. The disturbance continued after her arrest, when she allegedly began kicking the roof and partition of a police vehicle until deputies placed her in leg restraints.

Bethany Autumn Moon Cain, 24, was arrested October 18 on a misdemeanor domestic battery charge following the confrontation at a Volusia County residence.

According to a four-page arrest affidavit filed by the Volusia Sheriff’s Office, the dispute began between Cain and her boyfriend of three years before spilling outside and drawing his mother to the scene.

By the time deputies arrived, her boyfriend had scratches on his neck and back, his mother had witnessed part of the confrontation, and Cain had returned inside the residence. The encounter would become disruptive again when deputies attempted to transport her.

Deputies Erin Kavula and Aberle responded to the residence around 6:13 p.m., where Cain’s boyfriend told them the couple had been arguing because she had consumed an entire bottle of wine and was intoxicated. The two had lived together since 2024.

He said he asked Cain to leave, but when he attempted to leave the residence himself, she followed him outside, causing him to fall and scrape his knees and hands. According to his account, Cain then got on top of him and attempted to come after him again, prompting him to grab her wrists to prevent her from swinging at him.

During the struggle, he said Cain dug her fingers into his back and scratched his neck, leaving injuries that deputies subsequently photographed and uploaded into evidence.

Meanwhile, he had called his mother, who could hear Cain screaming during the argument. Concerned about what was happening, she drove to the residence, where she found her son lying on the ground with Cain on top of him.

His mother honked her horn, and Cain got up and ran toward her vehicle before falling on the gravel driveway and running off. She eventually returned inside the house, where she remained until deputies arrived.

The mother provided a sworn written statement describing what she witnessed, corroborating her son’s account of Cain being on top of him, although she had not witnessed the entire confrontation.

When Deputy Kavula spoke with Cain, she reported smelling alcohol on her breath and person. Cain’s speech was slurred, and she was emotional, occasionally screaming and having difficulty making herself understood.

Cain initially denied that anything physical had happened. When Kavula asked about the scratches on her boyfriend’s neck, Cain said she could not remember what had occurred.

The deputy questioned her again about the injuries, but Cain began hyperventilating and screaming before refusing to answer further questions. Another deputy subsequently obtained a sworn written statement from her, although its contents were not reproduced in the arrest affidavit.

Her boyfriend also agreed to complete a domestic violence lethality assessment, a screening process intended to identify warning signs associated with potentially dangerous situations. Based on his answers, deputies classified the incident as potentially lethal, although the affidavit does not specify which responses led to that determination.

Investigators provided him with information about his rights as a victim. After considering his injuries, his mother’s witness statement, and the circumstances described by those involved, deputies identified Cain as the primary aggressor and arrested her for domestic battery.

Taking Cain into custody did not end the disturbance.

During transport, deputies reported that she began kicking the roof of the patrol vehicle and the partition separating the passenger compartment. The behavior became disruptive enough that deputies placed her in leg restraints.

The affidavit does not describe any damage to the vehicle, and Cain’s booking record lists only the misdemeanor battery charge.

Deputies documented the investigation with body-worn camera recordings, photographs of the boyfriend’s injuries, and sworn statements. A criminal history check found that Cain had no prior battery convictions.

Volusia County booking records list the charge under Florida Statute 784.03(1)(a)1, with a $100 surety or cash bond.

All parties are presumed innocent until proven guilty in a court of law.
