10 Travel Protections For Passengers To Be Eliminated Effective As of October 19, 2026
10 travel protections for passengers are to be eliminated effective as of Monday, October 19, 2026 due to ten events that will be reclassified as within the control of an airline to outside the control of an airline as a result to changes of the FAA Reauthorization Act of 2024 that were recently approved. 10 Travel Protections For Passengers To Be Eliminated Effective As of October 19, 2026 Photograph Β©2026 by Brian Cohen. The following events that will no longer be considered within the control of the airline effective as of Monday, October 19, 2026 include:
Despite the aforementioned changes, passengers will still have the right to a refund if their flight is significantly delayed, which means that you are still entitled to a refund β regardless of whether the delay is within the control of the airline β if your flight is delayed greater than:
Keep in mind that if a passenger accepts any form of alternative compensation β such as a voucher for future travel, whose use is typically limited only to the airline; or a limited allowance for overnight accommodations β that passenger may not be entitled to a refund later. Even accepting a meal voucher that is worth ten dollars while waiting for a flight that is delayed may jeopardize the chance for obtaining a refund.
Airlines have committed to providing a certain amount of support based on the cause of the change in the flight schedule β despite the fact that airlines are not required by federal law in the United States to assist passengers who are delayed or stranded. Fuel delays or boarding complications are examples of events the DOT considers within the airlinesβ control, whereas air traffic control issues or threats to national security are not.
Predicting how many passengers will be impacted is virtually impossible; but according to this official document from the Department of Transportation of the United States, βthe number of delays and cancellations for which air carriers provide amenities and compensation to consumers is expected to be reduced.β
Members of the staff of some airlines may be granted the discretion of providing compensation to passengers who are inconvenienced that may be above and beyond what they are legally required β regardless of the law β but that is not guaranteed.
More likely, some other airlines may do everything possible to not spend a single cent more than necessary in keeping within the requirements of the law when providing compensation to passengers who are inconvenienced.
During my travels over the years, I do not believe that I have ever experienced any of the aforementioned ten events that are now classified as no longer within the control of the airline; so I believe the likelihood that I will be adversely affected in the future is negligible. I also believe that some airlines may still provide some form of compensation as a result of any of the aforementioned ten events β even if just to look good to the customer for future business; and especially if the passenger has earned some form of elite status.
Still, the changes are likely to affect many passengers every year, as airlines will no longer be required to provide support for certain types of delays pertaining to baggage, issues that are related to maintenance, or the cleaning of aircraft.

Also, be sure to take both photographs and screen shots of anything related to the delay or cancellation of a flight as proof for requesting a refund or some other form of compensation later in case whatever is taken in photographs or screen shots disappear at a later date.
Finally, morning flights are usually more reliable to arrive at their destinations on time as opposed to later flights, which can be affected by the domino effect of the cancellations and delays of earlier flights β as well as inclement weather, which is typically more prevalent later in the day than earlier.
