Nayyer Bukhari warns against prolonged emergency rule in KP
ISLAMABAD – Pakistan People’s Party (PPP) on Tuesday called for strict constitutional and parliamentary oversight of any move to impose an emergency or Governor’s Rule in Khyber Pakhtunkhwa (KP), declaring that extraordinary measures must remain within constitutional limits and should not continue beyond what the prevailing security situation warrants.
PPP Parliamentarians (PPPP) Secretary General Syed Nayyer Hussain Bukhari said that, with sessions of both Houses of Parliament summoned to deliberate on the proposed measures, decisions concerning the province’s administration, law and order, and security must be taken through the constitutional framework.

He underscored the importance of parliamentary approval, democratic accountability and respect for the rule of law.
In a statement, the senior PPP leader referred to Articles 232 and 234 of the Constitution, explaining that emergency proclamations and measures relating to a failure of constitutional machinery in a province are subject to prescribed constitutional procedures and parliamentary scrutiny.
Under Article 232, he said, an emergency proclamation must be placed before a joint sitting of Parliament within the constitutionally prescribed period of 30 days, with the applicable requirements for approval and continuation duly observed.

Bukhari said action under Article 234 concerning a situation in which the constitutional machinery of a province has failed cannot be treated as an open-ended arrangement. Governor’s Rule must remain subject to the prescribed parliamentary approval process and constitutional time limits, including the maximum permissible duration.
Emphasising the need to balance national security imperatives with democratic principles, Bukhari said the continuation of emergency measures must be determined by the circumstances prevailing in Khyber Pakhtunkhwa. If effective counterterrorism operations succeed in restoring peace, improving security and returning the province to normalcy, the necessity of extraordinary measures should be reassessed in accordance with the Constitution.

He maintained that democratic political forces did not want emergency arrangements to remain in place longer than necessary, stressing that extraordinary powers must not become a substitute for normal constitutional governance.
The PPPP secretary general underlined that the administration of Khyber Pakhtunkhwa must remain firmly anchored in constitutional provisions and parliamentary authority. Any decision affecting the province’s political and administrative future, he said, must be guided by the rule of law, democratic accountability and the overriding interests of its people.

Taking aim at the provincial government’s performance, Bukhari alleged that the previous provincial leadership had prioritised efforts to secure the release of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan over the responsibilities of effective governance and addressing public grievances.
He argued that failures in governance and an inadequate response to mounting law-and-order challenges had contributed to the circumstances confronting the province, where the restoration of peace and the protection of citizens remain critical concerns.
