Home Affairs Minister Leon Schreiber signed Immigration Directive 13 of 2026 on 2 October. The change removes the requirement to submit certain applications at least 60 days before visa expiry.
Previously, missing that deadline could trigger rejection, even when applicants met other requirements.
The waiver also offers relief to affected families and people awaiting appeal decisions. However, applicants must understand the deadline and other requirements that still apply.
According to Immigration Directive 13 of 2026, foreign nationals can submit eligible visa extension and status-change applications any time before their existing visas expire.
Previously, regulations required applications at least 60 days before expiry. Applicants who missed that window often needed additional waivers or appeals.
The Department of Home Affairs considered representations about unintended consequences arising from two immigration regulations. The minister subsequently granted a blanket waiver covering future applications and qualifying pending cases.
The change means applicants no longer need a separate waiver simply because they missed the 60-day deadline.
However, applicants should confirm which filing rules apply to their specific visa category.
No. The waiver does not permit applications after the existing visa expires. Applicants must submit their applications while their current visas remain valid.
Anyone renewing visa documents should check their expiry date and prepare supporting paperwork promptly. The waiver does not automatically extend a visa or grant permission to remain after expiry.
Some shorter-term visas may also carry different filing requirements. Fragomen’s immigration guidance highlights separate deadlines for certain short-term visas. Applicants should therefore confirm the applicable requirements before relying on the waiver.
Families affected by previous refusals may also benefit. When authorities rejected a primary applicant and consequently rejected dependants, they can now process qualifying family applications alongside the primary case.
The retrospective waiver could help the department resolve outstanding applications and appeals. Previously, officials faced additional administrative work involving individual waiver requests and deadline-related refusals.
Authorities will overturn pending appeals against refusals based solely on missing the 60-day deadline. The department can then adjudicate the underlying applications.
For anyone renewing visa documents, the message is clear: the 60-day rule no longer applies to covered applications.
The expiry date still matters, so submit your application before your existing visa expires.
