District, High Court Bar observe strike against emergency rule in KP

RAWALPINDI  –  Lawyers both at Lahore High Court Bar Association (LHCBA) and District Bar Association (DBA) Rawalpindi on Monday observed a complete strike against imposition of emergency and governor’s rule in Khyber Pakhtunkhaw by the federal government.

The lawyer bodies overwhelmingly termed the move as unconstitutional and unjustified saying the federal government had taken away the right of governance from the duly elected people and expressed utter disregard for the mandate of the KP people. The district bar in the general body meeting expressed grave concern over the imposition of emergency and Governor’s rule in the province under Articles 232 and 234 of the Constitution of Pakistan.

According to a press release issued by DBA Rawalpindi Secretary Qamar-ul-Haq Niazi, the legal body emphasised that extraordinary constitutional powers must be exercised with extreme caution, transparency, and complete adherence to constitutional requirements. The association stated that such powers should not be used on the basis of political differences to dismiss elected provincial governments or neutralize public mandates.

The DBA asserted that strict adherence to legal procedure and constitutional conditions is indispensable when imposing emergency measures. It highlighted that exercising these powers in an uncontained or controversial manner risks damaging provincial autonomy, democratic values, parliamentary supremacy, and trust among the federating units.

“All constitutional institutions must operate within their defined boundaries,” the statement of the bar read, urging that national, political, and provincial disputes be resolved through democratic and legal principles rather than political escalation. The general body meeting was held at 10:30am and the lawyers deliberated on the legal, constitutional, and democratic implications of the emergency enforcement in Khyber Pakhtunkhwa, accompanied by a complete strike by lawyers across the district courts.
