A Nigerian Man in SA Who Was Caught With Items Linked to SA Lady Killed At Kempton Park Charged
A Nigerian national remains at the centre of a bail dispute before the Kempton Park Magistrate’s Court after prosecutors opposed his release in a case involving property allegedly stolen from murder victim Elizabeth Tsontsho Moselakgomo.
The man, listed as accused number one, appeared alongside two other defendants in proceedings concerning a smartwatch said to have belonged to Moselakgomo. The case also involves an allegation of money laundering connected to the watch’s reported sale.
In a decision announced during the court appearance, the magistrate granted bail to accused numbers two and three. Each was required to pay R10,000 to secure release. The ruling does not mean the charges against them have been withdrawn or that the court has decided whether they are guilty.
The position of the first accused remains different. The State opposed his bail application while the Department of Home Affairs has yet to verify his immigration status in South Africa. The verification is an unresolved issue in the proceedings, and no conclusion about his legal right to remain in the country has been announced.
All three men are before the court on two charges arising from the alleged handling of the victim’s belongings. One charge concerns the suspected theft of a smartwatch. The other relates to alleged money laundering associated with its sale. The allegations are still to be tested in court, and the accused are entitled to the presumption of innocence.
The case has attracted attention because the property in question is linked to a woman who was murdered. However, the charges described in the current proceedings concern the watch and its alleged sale; the information disclosed does not establish that the three defendants are charged with her murder.
Authorities have also withheld the identities of the men. Investigations are described as being at a sensitive stage, and their names have not been released. This means the focus remains on the court’s decisions and the charges currently before it rather than the personal details of those accused.
The matter has now been postponed to 19 October 2026. When proceedings resume, attention is likely to return to the unresolved bail issue concerning accused number one, including the status verification being handled by Home Affairs.
For now, two defendants have been granted bail of R10,000 each, while the State continues to oppose bail for the Nigerian national. The criminal case remains ongoing, with no verdict reached on the allegations.
