Army to assist civil administration in maintaining peace in province

The federal government ordered on Sunday the deployment of the Pakistan Army troops in Khyber Pakhtunkhwa to assist the civil administration in maintaining law and order and protecting citizens and public installations.

The deployment has been authorised under Article 245 of the constitution. The Khyber Pakhtunkhwa governor will determine the number of troops and resources required in consultation with the Military Operations Directorate.

The army will assist the civil administration in maintaining peace and protecting lives and property.

Earlier, Federal Law Minister Azam Nazeer Tarar said at a press conference in Islamabad, alongside federal ministers Syed Mohsin Raza Naqvi and Attaullah Tarar, that the situation in Khyber Pakhtunkhwa required the imposition of governor’s rule and an emergency.

He said the federal government had delegated powers to the governor and formed an 11-member advisory council.

Nazeer Tarar said that the KP governor had provided important information in a letter and that President Asif Ali Zardari had acted within the Constitution. He accused the provincial leadership of prioritising politics amid what he described as a constitutional crisis.

The law minister said Article 232 allowed an emergency to be declared in the event of external aggression or internal disturbance. He said the situation in the province had warranted the decision.

Nazeer Tarar added that the federal government had authorised the KP governor to arrange the deployment of the army under Article 245. He said the decision would be presented to the parliament for approval, with a joint sitting to be convened.

The federal government has issued a gazette notification confirming the imposition of an emergency in Khyber Pakhtunkhwa by President Zardari under Articles 232(1) and 234(1) of the Constitution.

Under the notification, the federal government could direct the governor to assume all or some of the powers of the provincial government. The KP governor could exercise the powers and perform the duties delegated by the federal government.

The notification stated that the powers of the Khyber Pakhtunkhwa Assembly will be exercised by parliament or a designated body. The chief minister, provincial ministers, advisers, special assistants and advocate general will cease to hold office with immediate effect.
