Sergeant Fannie Nkosi Expected to Testify in Disciplinary Case Against Suspended Police Deputy Commissioner Sibiya

Suspended Deputy National Police Commissioner Lieutenant-General Shadrack Sibiya is expected to face further scrutiny during his disciplinary hearing, with Sergeant Fannie Nkosi listed among the witnesses likely to testify against him.

Nkosi, who previously served under Sibiya, was identified during the Madlanga Commission of Inquiry as an alleged go-between for Sibiya and businessman Vusimuzi “Cat” Matlala. His testimony is expected to play a significant role in the disciplinary proceedings against the senior police official.

Sibiya faces seven counts of alleged misconduct linked to evidence presented before the Madlanga Commission, which is investigating claims of corruption, criminal activity and political interference within South Africa’s criminal justice system. His disciplinary hearing was postponed until October 12 to give him more time to consult with his legal team.

Nkosi’s involvement stems from his earlier testimony before the commission, during which he discussed communications between Sibiya and Matlala. Evidence presented at the inquiry reportedly indicated that Nkosi facilitated WhatsApp messages between the two men, acting as an intermediary.

However, Sibiya has disputed the claim that Nkosi served as a designated middleman. In his own testimony before the commission, he denied any arrangement for the sergeant to relay messages between him and Matlala. Although he acknowledged communicating with Nkosi, Sibiya maintained that some of the information he shared with the sergeant was not meant to be passed on to the businessman.

Nkosi has challenged Sibiya’s version of events, describing parts of the senior officer’s testimony as untrue. He previously maintained that Sibiya had instructed him to facilitate communication with Matlala, leaving the commission with conflicting accounts from the two officers.

The disciplinary charge sheet outlines several serious allegations against Sibiya. One charge claims that he received R500,000 from Matlala in January 2024, while another alleges that he accepted an additional R300,000 in September of that year. A separate allegation concerns 20 impalas that Sibiya reportedly received from the businessman in March 2024. These claims have yet to be confirmed through a final disciplinary ruling.

Sibiya is also accused of improperly encouraging Matlala to open a case against members of the Political Killings Task Team after police raided the businessman’s residence in December 2024.

Other charges relate to the alleged unauthorised sharing of confidential police information. One allegation states that Sibiya instructed that an arrest warrant containing personal details about celebrity blogger Musa Khawula be sent to Matlala. During his earlier testimony, Nkosi claimed that Sibiya pressured him to share the document with the businessman.

Another charge alleges that Sibiya disclosed confidential information to Nkosi without obtaining authorisation from the national police commissioner. The final count concerns claims that Sibiya promised Nkosi a promotion or a position in a narcotics-related project.

In addition to the disciplinary proceedings, Sibiya is facing separate criminal allegations in a case before the Randburg Magistrates’ Court. He has denied the sexual offence allegations against him.

The disciplinary hearing is expected to bring renewed attention to Nkosi’s testimony and the contradictory accounts about his alleged role in facilitating communications between Sibiya and Matlala. As the process continues, all the allegations remain subject to examination, and Sibiya will have the opportunity to respond to the charges against him.
