‘My husband started threatening me with gun, sword, after he married a new wife’
Grade A Customary Court, sitting at Mapo, Ibadan, Oyo State, has put an end to the relationship between a couple, Melody and Fatai, over the allegations of lack of love and care, constant fight and threat to her life.
Melody who dragged her husband, Fatai to court stated that he was caring and that he showered her with love, affection and attention early in their marriage.
Melody said that their relationship was smooth and their home was a haven for others.
The plaintiff stated that the relationship between her and her husband suddenly turned sour and that he took to beating her.
Melody said that Fatai was in the habit of beating her black and blue, adding that he did not spear her even when she was pregnant.
The plaintiff further stated that things got worse between her and the defendant after he took a second wife and he started threatening her with gun and sword.
Melody said that she later moved out of her matrimonial home before Fatai made real his threat of killing her.
The plaintiff prayed that their union be dissolved.
She further pleaded for the custody of the only child produced by their wedlock.
The plaintiff further sought an order restraining the defendant from threatening and interfering with her private life.
Fatai refused to make an appearance in court despite being served court summonses.
Melody, in her evidence, said, “My lord, I pray that you annul my marriage to my husband before he kills me.
“He started threatening me with gun, sword, after he married a second wife.
“We held an introduction ceremony after we met and I moved in with him.
“We had a good relationship early in our marriage.
He was a loving and caring husband, and doted on me always.
“Our home was peaceful and a haven to many.
“All this changed after my husband suddenly became hostile and a terrible person to live with.
“He started beating me at every given opportunity.
“He would beat me black and blue and leave me hurting.
“He did not spare me even when I was pregnant.
“Things got worse in our home after he married a second wife.
“The sight of me became displeasing to him and he took to harassing and threatening me.
“My husband was in the habit of threatening me with either a gun or sword anytime we had an argument.
“I got so scared on one of the days and moved out of his house.
“My lord, I entreat this honourable court to end our relationship and grant me custody of the only child produced by our marriage.
“I also appeal that the court orders my husband to be responsible for our child’s upkeep, giving feeding, education and health care a priority.
“I further request an order restricting him from threatening and interfering with my private life.”
Ruling, the court president, Mrs S. M. Akintayo, stated that the defendant was given ample opportunity to defend himself, but that he refused to make use of it.
According to Akintayo, the plaintiff had the right to be granted her prayers.
Akintayo, therefore, pronounced their wedlock dissolved.
She granted the plaintiff custody of their child and ordered the defendant to be responsible for his upkeep.
Akintayo further gave an order restricting the defendant from threatening and interfering with the plaintiff’s private life.
