Details have emerged on what murder suspects Mbithe and six others told the court in their fight to leave jail.
They told the court that they were not likely to flee and should be granted bail, while their lawyers questioned the reasons given by the state for keeping them behind bars.Rose Mbithe, her children Chris Mulwa and Angela Mulwa, Police Constables Elijah Kibelion Kimoi and Collins Bett Kiplangat, Maritim Kimutai alias Kim, and Pius Muiru Mbugua alias Headboy are facing accusations over the death of Dr Victoria Nthunya Mutiso.
The seven denied the murder charges when they appeared before Milimani High Court Judge Alexander Muteti on Tuesday, October 6.
They were presented with fresh charges after the prosecution sought to bring two additional suspects into the case.
Mbithe and her two children asked to be freed on bail.
Their lawyers said they had no intention of escaping and would respect any conditions imposed by the court.
The defence also rejected the State’s arguments against their release.
The lawyers said medical documents showed that some of the accused needed specialised treatment.They added that their clients were willing to hand over their passports to the court if required.
On concerns about possible interference with witnesses, the lawyers said there was no reason to believe the three would interfere with the case.
They noted that some witnesses had already been placed under protection.
The defence also questioned an affidavit presented by Mbithe’s former husband, Prof David Ndetei.
The lawyers described the claims as unsupported, saying the court had not been shown messages or other evidence proving that Mbithe had threatened him.
The lawyers also raised allegations involving Daniel Mwande and Samuel Karanja.
They claimed the two had been encouraged to accuse Mbithe and her children in return for their freedom.
