A private legal practitioner Kwame Adofo has urged former Finance Minister Ken Ofori-Atta to take legal action against the Office of the Special Prosecutor (OSP) for what he describes as an unlawful declaration of him as a \u201cfugitive from justice.\u201d<\/p>\n
Mr Adofo made these remarks during a discussion on Asaase Radio\u2019s current affairs program, The Forum, on Saturday, February 15.<\/p>\n
He criticized the OSP\u2019s handling of high-profile cases, accusing the Special Prosecutor of overstepping his legal authority.<\/p>\n
He argued that the OSP has no legal basis to declare someone a fugitive, especially when no formal charges have been filed against the individual.<\/p>\n
\u201cI cannot see what gives the OSP the power to declare somebody a fugitive from justice. This is wrong and should never have been done. Ken Ofori-Atta has not been charged with any offense, yet he has been publicly maligned. This is a serious ground for legal action,\u201d Adofo stated.<\/p>\n
He added, \u201cI think Ken Ofori-Atta\u2019s lawyers should consider suing the Special Prosecutor personally.\u201d<\/p>\n
Adofo also pointed to the OSP\u2019s track record, citing the Cecilia Dapaah investigation, later dismissed by the courts, as evidence of incompetence. He argued that the Special Prosecutor\u2019s approach to investigations is flawed and damages the institution\u2019s credibility.<\/p>\n
\u201cWhat serious investigator announces an investigation before even starting? He did the same thing with the NPA case. When you do that, people hide evidence and obstruct investigations. This clearly shows incompetence, and he needs to be removed,\u201d Adofo asserted.<\/p>\n
He further questioned the Special Prosecutor\u2019s performance since taking office in 2021, asking, \u201cWe are in 2025\u2014can he account for his stewardship? Has he secured a single conviction in four years?\u201d<\/p>\n
Adofo called on the government to reevaluate the leadership of the OSP, stating that the current Special Prosecutor has failed to deliver on his mandate and should either resign or be removed from office.<\/p>\n
\u201cThe OSP\u2019s credibility is at stake, and the government must act to restore public trust in the institution,\u201d he concluded.<\/p>\n
