‘Kissi Agyebeng colluded with Ken Ofori-Atta to leave Ghana’

Renowned private legal practitioner Martin Kpebu has accused the Special Prosecutor, Kissi Agyebeng, of being responsible for the exit of former Minister of Finance, Ken Ofori-Atta, who is a subject of several investigations by the Office of the Special Prosecutor, from Ghana.

According to Kpebu, Kissi Agyebeng’s recent admission in an interview with veteran broadcaster Kwaku Sintim-Misa (KSM) that he watched Ken Ofori-Atta leave and was powerless to stop him makes him complicit in the former minister’s exit.

He explained that the Special Prosecutor should have told Ghanaians the challenges he was facing and not just watched the former minister leave.

“I told you that I suspected collusion between Kissi Agyebeng and Ken Ofori-Atta. There you have it; he has forced Kissi Agyebeng to come and confess. You heard the statement. He said he watched Ken Ofori-Atta leave. He watched him leave. He was powerless to prevent it.

“He went to the Immigration Service but didn’t get help. He went to NIB but didn’t get help. When the obvious answer, and the best, was around — that is, tell the sovereign, the owner of the country, the ultimate decider of things in this republic, that is the people of Ghana,” he said in an interview on TV3’s The KeyPoints on November 8, 2025.

He added, “Let’s not forget, first-class graduate — first-class graduate of law — and Kissi doesn’t understand the Constitution that the ultimate decider of major decisions in Ghana is the public. Inform the people. That is the preamble to the Constitution. Sovereignty resides in the people of Ghana — Article 1(1).”

The lawyer also alleged that there are a lot of instances of corruption at the OSP under the watch of Kissi Agyebeng.

“There are a lot of corruption cases that are brewing in the OSP itself. The Office of the Special Prosecutor has become a crime scene. And I’m telling you this on authority. Let’s go conduct a poll in the OSP office today; you will see the myriad of allegations against Kissi.

“I want to say they are going to answer this question: are there two employees of the OSP who are currently working as house helps in his home? Are there two members of staff who are currently working as house helps? Meanwhile, they are on the OSP payroll. Kissi Agyebeng should tell the people of Ghana, who is Kwabena Boateng Adu, popularly called Baron?” he quizzed.

What Kissi Agyebeng said:

The Special Prosecutor, Kissi Agyebeng, has accused some security agencies in the country of sabotaging the investigation into former Minister of Finance Ken Ofori-Atta during former President Nana Addo Dankwa Akufo-Addo’s administration.

According to him, the Office of the Special Prosecutor (OSP) has been wrongly blamed for allowing Ken Oforn-Atta to leave the country.

Speaking in a recent interview with veteran broadcaster Kwaku Sintim-Misa (KSM), Kissi Agyebeng said his office at the time had no power to prevent the former finance minister from leaving the country.

“We have attracted some flak asking, ‘Why did we allow him to go?… He left between January 1st and 6th, I know the date, but I’m not going to say it. Who was in power during those few days?

“And we don’t control the airports. The OSP does not control exit points. Yet, we are criticised day in and day out, being asked, ‘Why did you allow him to leave?”

He added, “His cousin was president. We didn’t watch him leave. We were powerless; we saw him leave, but we couldn’t prevent it. At the time, if you called immigration, no one would even respond.”
