Adu Boahen trial: ‘What they’re hiding will set us free’

Lead counsel for Kwabena Adu Boahen, the embattled former Director-General of the National Signals Bureau, Samuel Atta Akyea, says his client is innocent and will be vindicated once key evidence which he claims is currently being withheld is disclosed.

He said this following a ruling by the High Court in Accra, which dismissed his legal team’s objection to the Attorney General’s move to withdraw charges against the third accused, Mildred Donkor. Donkor has now been discharged and is expected to testify for the prosecution.

Despite this setback, Atta Akyea expressed confidence in Adu Boahen’s innocence and criticised what he described as the deliberate withholding of evidence that could help his client.

“We are fortified that our client is very innocent but we will fight on, and I am sure another forum will compel the disclosures to come to us and we can do a good job because these are the weapons of our warfare.

“What they are trying to hide is what will set us free,” he said in an interview on Citi Eyewitness News on Friday October 17.

The ongoing case involves allegations of theft and misappropriation of about GHS49 million in state funds. The charges are against Adu Boahen, his wife Angela Adjei-Boateng, and their company, Advantage Solutions Limited.

The Attorney General, Dr. Dominic Ayine, filed a notice to withdraw the case against Donkor under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30), after she reportedly agreed to become a prosecution witness.

Akyea’s team had argued that the Attorney General should have made the withdrawal through a formal motion, considering the significant shift in the case. However, Justice John Nyadu Nyante ruled that the Attorney General acted within his constitutional mandate and dismissed the objection.

Despite the court’s position, Atta Akyea maintains that transparency and full disclosure are necessary for a fair trial. His team is expected to pursue other legal avenues to compel the release of what they believe is crucial evidence.
