Adu Boahen trial: Mildred Donkor had no hand in alleged GHS49m theft

Lawyer for Mildred Donkor, the discharged third accused person in the ongoing criminal trial involving former Director-General of the National Signals Bureau (NSB), Kwabena Adu-Boahene, has welcomed the court’s decision to free his client.

Elikplim Agbemava, counsel for Ms. Donkor, said the ruling vindicated his client, who, according to him, had no involvement in the alleged theft and money laundering scheme at the centre of the case.

“If you see, my client was not mentioned as being part of the crime of stealing. Her name only appears in count 10 or 11 or so. It’s pretty clear that in terms of the formation of whatever has gone wrong, she was not part of that conclave to decide on anything,” Mr. Agbemava told journalists after the Accra High Court refused an application by the defence to stay the criminal trial on Friday, October 17.

His comments followed the decision by the Attorney-General and Minister for Justice, Dr. Dominic Ayine, to discontinue prosecution against Mildred Donkor in the ongoing GHS 49 million theft case involving Mr. Adu-Boahene, his wife Angela Adjei-Boateng, and Advantage Solutions Limited.

According to a notice filed at the High Court on Wednesday, October 15, 2025, Ms. Donkor was formally discharged under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30). The decision came after she reportedly agreed to serve as a prosecution witness in the case.

Her testimony is expected to clarify the alleged theft and misappropriation of state funds that led to charges against the former NSB boss, his wife, and their company.

Ms. Donkor’s change in legal position was first signaled on July 18, when she unexpectedly dismissed her lawyer in open court moments before the prosecution was due to call its first witness.

“I wish to take a separate lawyer, please,” she told the judge at the time, suggesting a shift in her legal strategy.

Sources at the Attorney-General’s Department said in her witness statement, Ms. Donkor described her relationship with the first and second accused persons as longstanding, noting that it dated back to their membership at the Cedar Mountain Assemblies of God Church in East Legon.

She stated that she became a director of Advantage Solutions Limited at the request of Mr. Adu-Boahene, who needed an additional director for company registration purposes. However, she clarified that her role was largely ceremonial.

“Although I was listed as a director, I had no decision-making power and only acted on instructions from Mr. Adu-Boahene and Madam Adjei-Boateng,” she said.

With her discharge, prosecutors are now expected to rely on her cooperation and testimony to bolster their case against the remaining accused persons as the high-profile trial continues before the Accra High Court.
