Ofori-Atta’s Absence in US Won’t Stop OSP from Taking Legal Action

Private legal practitioner Martin Kpebu has stated that the Office of the Special Prosecutor (OSP) can initiate legal proceedings against former Finance Minister Ken Ofori-Atta, regardless of his current location as per reports from Ghana Web on Saturday, June 21, 2025.

Speaking on TV3’s Key Points, Kpebu noted that even if Ofori-Atta is undergoing treatment at the Mayo Clinic in the United States, the OSP can still proceed with charges and take caution statements.

He explained that the law does not require Ofori-Atta’s physical presence in Ghana before legal action is taken, emphasizing that the OSP could travel abroad to collect a statement.

“If Ofori-Atta says he won’t speak, it does not stop the OSP from going to court,” he remarked.

Professor Ransford Gyampo also questioned whether the OSP had confirmed Ofori-Atta’s exact location and status, asking if any effort had been made to verify his presence at the Mayo Clinic.

Dr. Joshua Zaato added that Ghana’s National Security could assist in tracking Ofori-Atta’s passport and confirming his whereabouts.

The situation escalated after the OSP, led by Kissi Agyebeng, announced on June 2 that Ofori-Atta had failed to appear as scheduled and would be placed on a wanted list once again.

Agyebeng stressed that illness was not a valid reason to avoid legal responsibility unless it rendered the individual incapable.

In response, Angela Ofori-Atta defended her husband, explaining that he is currently receiving cancer treatment and has offered to cooperate virtually.

She expressed concern over the OSP’s refusal to accommodate remote participation, saying, “He has always said, let me respond to you by video… I don’t understand what is going on.”
