Legal counsel for the former Director-General of the National Signals Bureau, Samuel Atta Akyea, has disclosed that the Attorney General and Minister for Justice, Dr Dominic Akuritinga Ayine, is seeking the remand of his client, Kwabena Adu Boahene, following charges brought against him.
Speaking to the media at the premises of the Accra High Court after his clients, Kwabena Adu Boahene and his wife, Angela Adjei Boateng, pleaded not guilty to all charges, Atta Akyea explained that the Attorney General’s request for remand is based on suspicions that his clients may be attempting to interfere with ongoing investigations into alleged embezzlement of state funds.
However, he expressed dissatisfaction with the state prosecutor’s claims, stating that he does not believe the allegations.
Asked by journalists if he believed the Attorney General’s claims, Atta Akyea simply responded, “At all.”
Atta Akyea, a former Member of Parliament for Akim Abuakwa South, further revealed that the presiding judge has directed both the Attorney General and the defense team, along with the accused, to return to court on Friday to determine whether any further investigations remain outstanding.
“The judge says we should come on Friday for the Attorney General to show whether there are any residual investigations to be conducted, but he is insisting that Kwabena Adu Boahene should be remanded,” he added.
Meanwhile, the Attorney General has filed 11 charges against Kwabena Adu Boahene, accusing him of transferring GH¢49 million (approximately $7 million) from the bureau’s account into his personal account, among other offenses.
The suit, filed at the High Court in Accra, also names three other accused persons; Angela Adjei Boateng (his wife), Advantage Solutions Limited (his company), and Mildred Donkor (a banker).
The charges filed include:
• Stealing, contrary to Section 124(1) of the Criminal Offences Act, 1960 (Act 29);
• Conspiracy to steal, contrary to Sections 23(1) and 124(1) of the same Act;
• Defrauding by false pretences, contrary to Section 131(1);
• Wilfully causing financial loss to the state, contrary to Section 179A(3)(a);
• Using public office for profit, contrary to Section 179C(a); and
• Collaboration to commit a crime, specifically using public office for profit, contrary to Section 179C(b) of the Act.
