{"id":271860,"date":"2024-12-28T09:40:35","date_gmt":"2024-12-28T09:40:35","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/12\/28\/the-ec-is-acting-like-a-law-unto-themselves-inusah-fuseini\/"},"modified":"2024-12-28T09:40:35","modified_gmt":"2024-12-28T09:40:35","slug":"the-ec-is-acting-like-a-law-unto-themselves-inusah-fuseini","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/12\/28\/the-ec-is-acting-like-a-law-unto-themselves-inusah-fuseini\/","title":{"rendered":"\u2018The EC is acting like a law unto themselves\u2019 &#8211; Inusah Fuseini"},"content":{"rendered":"<br><div id=\"article-text\">\n                       \n                        \n<p class=\"wp-block-paragraph\">Private legal practitioner and former MP for Tamale Central, Inusah Fuseini, has accused the Electoral Commission (EC) of acting as though it is above the law. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking on Joy News\u2019 <em>Newsfile<\/em> on Monday, December 28, Fuseini expressed concern over what he described as the EC\u2019s overreach and failure to respect legal procedures in electoral matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen we were in Parliament in 2020, and the Electoral Commission appeared to answer questions, it appeared to me then\u2014and has since been confirmed by many people\u2014that the Electoral Commission was acting as if they were a law unto themselves,\u201d Mr Fuseini said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His comments come after the Supreme Court quashed results in the re-collation of votes Tema Central, Ablekuma North, Techiman South, and Okaikwei Central in the 2024 parliamentary elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The apex court added that the order does not affect Ahafo Ano North and Nsawam Adoagyiri results.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the court, the trial judge violated the right to a hearing of the NDC Parliamentary Candidates when they applied to the High Court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read also:\u00a0<a>Re-collation: Supreme Court quashes results in Tema Central, Ablekuma North, Techiman South, Okaikwei Central<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mr Fuseini questioned the EC\u2019s decision to take matters into its own hands in determining compliance with CI 127, the law governing electoral disputes. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe EC chair says the processes did not comply. Who determines whether the processes have complied with CI 127? Is it the EC? No. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Another institution of state must determine whether or not the processes at the polling station or the coalition centre have complied with the law,\u201d he emphasised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fuseini argued that the EC\u2019s actions reinforce perceptions of bias and undermine public confidence in the electoral process. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe EC arrogating to themselves the power to determine compliance with CI 127 is what has led us to this crisis. It reinforces the perception of bias,\u201d he asserted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also criticised the EC for taking an unusual interest in a court case where they were not the aggrieved party. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhy is the EC suddenly taking so much interest in a case where someone else\u2014a party to the election\u2014alleged in court that their officer was put under duress?
