{"id":271594,"date":"2024-12-27T18:22:49","date_gmt":"2024-12-27T18:22:49","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/12\/27\/supreme-court-quashes-high-court-orders-in-disputed-election-results\/"},"modified":"2024-12-27T18:22:49","modified_gmt":"2024-12-27T18:22:49","slug":"supreme-court-quashes-high-court-orders-in-disputed-election-results","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/12\/27\/supreme-court-quashes-high-court-orders-in-disputed-election-results\/","title":{"rendered":"Supreme Court Quashes High Court Orders In Disputed Election Results"},"content":{"rendered":"<p><\/p>\n<div>\n<p>\u00a0<\/p>\n<p>In a landmark decision, the Supreme Court of Ghana has quashed the High Court\u2019s mandamus orders directing the Electoral Commission (EC) to re-collate parliamentary election results in four constituencies.<\/p>\n<p>The affected constituencies are Okaikwei Central, Ablekuma North, Tema Central, and Techiman South.<\/p>\n<p>This decision is a significant development in the ongoing electoral disputes, and it underscores the Supreme Court\u2019s commitment to upholding constitutional rights and procedural fairness.<\/p>\n<p>The Supreme Court\u2019s decision was in response to an application by the National Democratic Congress (NDC) challenging the High Court\u2019s orders.<\/p>\n<p>The NDC argued that the High Court breached the rules of natural justice by failing to grant them a proper hearing before issuing the orders.<\/p>\n<p>The NDC\u2019s application was based on the grounds that the High Court\u2019s failure to accord them a hearing was a fundamental breach of natural justice, and that the orders were procedurally flawed.<\/p>\n<p>The Supreme Court, in a unanimous decision, held that the High Court\u2019s failure to accord the NDC a hearing was indeed a fundamental breach of natural justice.<\/p>\n<p>The Court emphasized the sacrosanct nature of the right to a hearing, citing Article 23 of the 1992 Constitution and the case of Awuni v.
