Accra, Dec. 27, GNA \u2013 The Supreme Court is set to hear an application filed by the National Democratic Congress (NDC) concerning the re-collation of parliamentary results in six constituencies.\u00a0\u00a0<\/p>\n
The NDC is seeking to overturn a decision made by the High Court that granted the Electoral Commission (EC) permission to re-collate and declare results for the contested constituencies.\u00a0\u00a0<\/p>\n
The High Court, on December 20, 2024, ruled in favor of the EC, ordering a re-collation of results and the declaration of results in several constituencies that are still in dispute.\u00a0\u00a0\u00a0<\/p>\n
The court also directed the Inspector General of Police (IGP) to ensure adequate security at the collation centers during the process.\u00a0\u00a0<\/p>\n
The ruling followed a writ of mandamus filed by parliamentary candidates from the ruling New Patriotic Party (NPP) in the six constituencies: Tema Central, Techiman South, Ahafo Ano North, Okaikwei Central, Ablekuma North, and Nsawam Adoagyiri.\u00a0\u00a0\u00a0<\/p>\n
These constituencies have been at the center of electoral disputes, with both the NPP and NDC disputing the results.\u00a0\u00a0<\/p>\n
In response, the NDC filed an order of Certiorari with the Supreme Court, seeking to quash the High Court\u2019s decision.\u00a0\u00a0\u00a0<\/p>\n
The NDC contends that the High Court\u2019s ruling was made in violation of their rights to be heard and accused the trial judge of bias and partiality in the proceedings.\u00a0\u00a0<\/p>\n
Additionally, the NDC is requesting a prohibition order from the Supreme Court to prevent the Electoral Commission from re-collating, recounting, or declaring results in the six constituencies.\u00a0\u00a0\u00a0<\/p>\n
The party also seeks to restrain the IGP from providing security for what it describes as the \u201cunlawful exercise\u201d of re-collating and declaring results.\u00a0<\/p>\n
\u201cThe High Court committed a non-jurisdiction error of law by failing to exercise its powers under Order 55 rule 5 (2) of CI 47 to direct interested parties to serve the mandamus applications on the applicants who have interest in the subject in dispute,\u201d the NDC said.\u00a0<\/p>\n
It further held that there was an error of law apparent on the face of the record which error of law occasioned a substantial miscarriage of justice.\u00a0<\/p>\n
The Supreme is expected to hear the matter on December 27, 2024.\u00a0<\/p>\n
Meanwhile the EC has gone ahead to re-collate and declared results in some of the constituencies soon after the High Court had granted the writ of mandamus.\u00a0<\/p>\n
