Key recommendations include:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Marriage Documentation<\/strong>: Recognizing marriage certificates as primary proof of marriage, while permitting exceptions for certain cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Rights for Moroccans Abroad<\/strong>: Allowing marriage registration without the presence of two Muslim witnesses in specific circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Marriage Age<\/strong>: Setting the legal marriage age at 18 (Gregorian calendar), with exceptions for 17-year-olds under strict conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Polygamy<\/strong>: Requiring a wife\u2019s explicit consent to polygamy, with strict legal conditions limiting its justification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Divorce<\/strong>: Introducing consensual divorce contracts without judicial intervention and setting a six-month resolution period for divorce and repudiation cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Asset Management<\/strong>: Recognizing the economic contribution of a wife\u2019s domestic work to marital assets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Child Custody<\/strong>: Treating child custody as a shared right during marriage and potentially extending this after separation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Inheritance<\/strong>: Adopting the Supreme Council of Ulemas\u2019 recommendation for equitable asset distribution among heirs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 <strong>Modernization<\/strong>: Updating obsolete legal terms and incorporating modern technologies, such as electronic notifications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>General Proposals Supporting the Reform<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposals also suggest enhancing family justice through measures like:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Establishing specialized training for family court judges and staff.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Creating a one-stop shop for family law services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Raising awareness of marital rights and obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 Developing a national registry for marriage and divorce certificates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A Forward-Looking Revision<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minister Ouahbi highlighted that the reform seeks to balance Morocco\u2019s cultural and religious heritage with its commitment to progress in human rights. \u201cThis profound revision respects the principles of justice, equality, and solidarity, ensuring the Family Code evolves with the times while maintaining its foundation in Sharia,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Participation and Ownership<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">King Mohammed VI\u2019s vision for this reform emphasized inclusivity and constructive collaboration.
