{"id":261699,"date":"2024-12-06T15:35:25","date_gmt":"2024-12-06T15:35:25","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/12\/06\/peaceful-transfer-of-power-in-ghana-no-longer-an-internal-achievement-edite-ten-jua\/"},"modified":"2024-12-06T15:35:25","modified_gmt":"2024-12-06T15:35:25","slug":"peaceful-transfer-of-power-in-ghana-no-longer-an-internal-achievement-edite-ten-jua","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/12\/06\/peaceful-transfer-of-power-in-ghana-no-longer-an-internal-achievement-edite-ten-jua\/","title":{"rendered":"Peaceful transfer of power in Ghana no longer an internal achievement &#8211; Edite Ten Jua"},"content":{"rendered":"<br><p>Former Minister of Justice, Former Minister of Foreign Affairs, Sao Tome &amp; Principe and Member of Africa Governance Centre<\/p><div id=\"article-text\">\n                       \n                        \n<p class=\"wp-block-paragraph\">Her Excellency Edite Ten Jua, a former Minister of Justice and Foreign Affairs and a former member of the Constitutional Court of S\u00e3o Tom\u00e9 and Pr\u00edncipe, has praised Ghanaians for the country\u2019s pivotal role in advancing peaceful democratic transitions.<gwmw style=\"display:none;\"\/><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She highlighted Ghana as a beacon of inspiration for many nations due to its unwavering commitment to constitutional democracy and its active role in promoting political stability within the West African sub-region.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Her Excellency Ten Jua made these remarks during a Ghana Elections Roundtable organised by the Africa Governance Centre on Friday, 29th November 2024.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.myjoyonline.com\/wp-content\/uploads\/2024\/12\/WhatsApp-Image-2024-12-06-at-2.55.27-PM-910x1024.jpeg\" alt=\"\" class=\"wp-image-10032652932\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Under the theme, \u201cThe Judiciary and Ghana\u2019s Electoral Democracy\u201d, the event brought together experts and stakeholders from across the region to share experiences and reflect on strategies for free, fair, and transparent elections in Ghana.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In her address, she emphasised that Ghana\u2019s democracy must withstand the test of time, particularly in light of recent challenges in the sub-region, including calls for electoral reforms, political instability, and domestic economic difficulties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe 7th December election will not only determine Ghana\u2019s president or parliamentarians but will also serve as a critical affirmation of Ghana\u2019s credentials as one of Sub-Saharan Africa\u2019s most resilient and respected democracies,\u201d she stated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Roundtable also featured Justice William Atuguba, a former Justice of the Supreme Court of Ghana, who presided over the 2012 presidential election petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Atuguba vehemently refuted claims that election petitions disproportionately favour incumbents, citing the 5-4 split decision during the historic 2012 Election Petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He underscored the necessity of judicial independence, noting that the protections under the 1992 elections framework are insufficient, and called for a review of the judiciary\u2019s appointment process to reduce the executive branch&#8217;s overwhelming influence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other high-profile speakers included Justice Dennis Dominic Adjei of the Court of Appeal and the African Court on Human and Peoples\u2019 Rights; Professor Ernest Kofi Abotsi, Dean of the UPSA Law School; and Mr Doug Coltart, a lawyer and human rights advocate from Zimbabwe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Adjei, reflecting on the evidential requirements in court during election petitions, criticised the precedent set by the apex court in the 2020 Election Petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He argued: \u201cOne cannot tell a party they will not be allowed to call a witness, especially when it is their right to do so. The fundamental principle is that a party has the right to call witnesses, and if they are unwilling to appear, the coercive powers of the court should compel their attendance. If they fail to comply, they can be held in contempt. Denying a party the ability to call a witness is a significant disservice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Professor Abotsi stressed that the courts should prioritise substantive matters over procedural technicalities in election petitions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He argued that the courts should not concern themselves with who wins or loses but instead focus on uncovering the truth, as the ultimate objective is justice. \u201cThe courts must take an interest in vindicating the individual who has genuinely been elected,\u201d he added.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Doug Coltart, addressing fairness in the courts, observed that electoral litigation is inherently political, placing the judiciary in the challenging position of making decisions with political ramifications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To ensure transparency, he suggested: \u201cThe courts must do everything within their power, within the framework of the rules as currently framed, to provide parties and citizens access to evidence crucial for election petitions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Africa Governance Centre, which organised the event, is a think tank dedicated to promoting good governance, democracy, and economic transformation across the African continent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its mission is to work with governments, civil society organisations, democratic institutions, and international partners to strengthen institutions and foster transparent, inclusive governance processes.<\/p>\n\n                <p><strong>DISCLAIMER: <\/strong>The Views, Comments, Opinions, Contributions and Statements made by Readers and Contributors on this platform do not necessarily represent the views or policy of Multimedia Group Limited.<\/p>      \n               \n <!-- Post Tags -->\n                \n\n                        \n\n    \n                                 \n                                             \n                    <\/div>\n","protected":false},"excerpt":{"rendered":"<p>Former Minister of Justice, Former Minister of Foreign Affairs, Sao Tome &amp;
