{"id":256195,"date":"2024-11-27T04:45:51","date_gmt":"2024-11-27T04:45:51","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/11\/27\/flawed-from-the-start-martin-amidu-dismisses-supreme-court-ruling-backing-majority-leader\/"},"modified":"2024-11-27T04:45:51","modified_gmt":"2024-11-27T04:45:51","slug":"flawed-from-the-start-martin-amidu-dismisses-supreme-court-ruling-backing-majority-leader","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/11\/27\/flawed-from-the-start-martin-amidu-dismisses-supreme-court-ruling-backing-majority-leader\/","title":{"rendered":"&#8216;Flawed from the start&#8217; &#8211; Martin Amidu dismisses Supreme Court ruling backing Majority Leader"},"content":{"rendered":"<br><div id=\"article-text\">\n                       \n                        \n<p class=\"wp-block-paragraph\">Former Attorney General Martin Amidu has launched a scathing critique of the Supreme Court judgment cited by the Majority Leader in his memorandum to the Speaker. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to the November 12, 2024, ruling in <em>Alexander Afenyo Markin v Speaker of Parliament &amp; Attorney General<\/em>, Amidu described the decision as a \u201cper incuriam judgment,\u201d delivered without proper regard for constitutional and procedural requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a>Supreme Court rules: Speaker\u2019s declaration of four seats vacant is unconstitutional<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court of Ghana by a 5-2 decision ruled that the Speaker,\u00a0Alban Bagbin&#8217;s declaration of four seats as vacant is unconstitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a brief sitting the Chief Justice,\u00a0Gertrude Torkornoo\u00a0said the Speaker&#8217;s declaration cannot hold. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read also:\u00a0Speaker Bagbin declares 4 Parliamentary seats vacant<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his analysis of the ruling, Mr Amidu argued that the case was fundamentally flawed from its inception. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Majority Leader had no cause of action under Articles 2 and 130 of the Constitution,\u201d he stated, noting that the legal action was initiated on October 15, 2024, before the Speaker had made any pronouncements on the debated motion in question. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to him, this sequence invalidates the plaintiff\u2019s claim, rendering the judgment void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Highlighting procedural lapses, Mr Amidu pointed out that the plaintiff\u2019s case lacked the affidavit verification required under Rule 46 of the Supreme Court Rules. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis issue was specifically raised upon the Speaker\u2019s application to set aside the plaintiff\u2019s action as being incurably null and void, but the Court refused or failed to address this fundamental issue of jurisdiction,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Read also: <a>Martin Amidu: The majority leader\u2019s memorandum to recall Parliament is needless now<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amidu also accused the Court of improperly incorporating materials from interlocutory applications into the substantive case. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe majority decision had no jurisdiction to import the process filed for the interlocutory applications into the substantive suit as though the Speaker had filed them as his statement of the defendant\u2019s case,\u201d he argued, referencing prior Supreme Court rulings to buttress his critique.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe judgment of 12 November 2024 can only pass for an advisory opinion which is unknown to Articles 2 and 130 of the 1992 Constitution,\u201d Mr Amidu declared, adding that the decision has compromised public trust in both Parliament and the judiciary. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He concluded with a call for a reset in governance: \u201cThe earlier the 8th Parliament clears off from the political scene, the better for the 1992 Constitution.\u201d<\/p>\n\n\n\n\n\n                <p><strong>DISCLAIMER: <\/strong>The Views, Comments, Opinions, Contributions and Statements made by Readers and Contributors on this platform do not necessarily represent the views or policy of Multimedia Group Limited.<\/p>      \n               \n <!-- Post Tags -->\n                \n\n                        \n\n    \n                                 \n                                             \n                    <\/div>\n","protected":false},"excerpt":{"rendered":"<p>Former Attorney General Martin Amidu has launched a scathing critique of the Supreme Court judgment cited by the Majority Leader in his memorandum to the Speaker.
