{"id":181922,"date":"2024-05-14T06:11:24","date_gmt":"2024-05-14T06:11:24","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/05\/14\/win-for-mirema-estate-residents-as-court-orders-closure-of-clubs-and-church-over-noise-pollution\/"},"modified":"2024-05-14T06:11:24","modified_gmt":"2024-05-14T06:11:24","slug":"win-for-mirema-estate-residents-as-court-orders-closure-of-clubs-and-church-over-noise-pollution","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/05\/14\/win-for-mirema-estate-residents-as-court-orders-closure-of-clubs-and-church-over-noise-pollution\/","title":{"rendered":"Win For Mirema Estate Residents as Court Orders Closure of Clubs and Church Over Noise Pollution"},"content":{"rendered":"<p><\/p>\n<div>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-313725\" alt=\"\" width=\"830\" height=\"445\"  data-lazy- src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2024\/05\/kasa.jpg\"\/><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-313725\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2024\/05\/kasa.jpg\" alt=\"\" width=\"830\" height=\"445\"  \/>In a landmark decision, the Environmental and Land Court (ELC) has ordered the closure of three clubs and a church in Nairobi\u2019s Mirema Estate, imposing fines totaling Kes.5 million for noise pollution violations.<\/p>\n<p>The ruling, a victory for the Amani Residents Welfare Association\/Mirema, follows pleas by residents led by Dominic Mbigi, the association\u2019s chairman, and resident John Koogi.<\/p>\n<p>The petition, spearheaded by Mbigi and Koogi, accused Cocorico Wines, Paris Lounge and Grill, La Tessara Lounge, and Trinity House International Ministry of infringing upon residents\u2019 right to a clean and serene environment, as guaranteed by Article 42 of the Constitution.<\/p>\n<p>After thorough deliberation, the court concluded that the noise from these establishments severely compromised residents\u2019 well-being, prompting compensation for the distress caused by the bars and church operating within the vicinity.<\/p>\n<p>Additionally, the presiding judge held both the National Environmental Management Authority (NEMA) and Nairobi City County accountable for their negligence in safeguarding residents\u2019 rights.<\/p>\n<h5><strong>Cancellation of licenses<\/strong><\/h5>\n<p>Simultaneously, the court issued several orders, including the cancellation of licenses issued for the sale of alcoholic beverages within the estate.<\/p>\n<p><em>\u201cBy order of this Honourable Court under Article 70 of the Constitution, the license issued by the 6th respondent to the 1st to 3rd respondents for the sale of alcoholic beverages within a residential area is hereby revoked,<\/em>\u201d ELC Judge Judy Omange ruled.<\/p>\n<p>Residents had long voiced their grievances, citing the disruptive impact of the entertainment venues and alcohol outlets, which blared loud music late into the night, disrupting sleep patterns.<\/p>\n<p>The church, too, faced criticism for its use of booming sound systems during services, particularly on Friday nights and Sundays, causing undue disturbance to the neighborhood.<\/p>\n<p>The court also mandated the OCS Kasarani Police Station and\/or Roysambu Assistant County Commissioner to assist in implementing the court\u2019s orders.<\/p>\n<p><em>\u201cThe people of Kenya can only realize the promise of the Constitution of Kenya if public servants are responsive to the concerns of citizens.
