{"id":164046,"date":"2024-03-21T12:19:15","date_gmt":"2024-03-21T12:19:15","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/03\/21\/alves-granted-e1m-bail-after-sexual-assault\/"},"modified":"2024-03-21T12:19:15","modified_gmt":"2024-03-21T12:19:15","slug":"alves-granted-e1m-bail-after-sexual-assault","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/03\/21\/alves-granted-e1m-bail-after-sexual-assault\/","title":{"rendered":"Alves Granted \u20ac1m Bail After Sexual Assault"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>Dani Alves<\/strong><\/p>\n<p>\u00a0<\/p>\n<p>Former Brazil footballer Dani Alves has been granted release on bail for \u20ac1 million ($1.1m) upon appeal, a court in Barcelona, Spain, announced on Wednesday.<\/p>\n<p>Alves, 40, was convicted of sexual assault last month and sentenced to four and a half years in prison, of which he had already served over a year.<\/p>\n<p>His lawyer, In\u00e9s Guardiola, fought the ruling and, following a hearing on Tuesday, Alves has been released pending a final resolution in the appeal.<\/p>\n<p>Alves\u2019 release is also dependent on handing in his Spanish and Brazilian passports, remaining in Spain and agreeing to weekly court check-ins.<\/p>\n<p>He also must adhere to a restraining order that prevents him from going within 1,000 metres of his victim, her home, her place of work or any other place she is known to frequent.<\/p>\n<p>All parties involved \u2014 the defence, the victim\u2019s legal team and the prosecution \u2014 have three days to appeal Wednesday\u2019s ruling.<\/p>\n<p>Ester Garc\u00eda, the victim\u2019s lawyer, expressed her disappointment with the ruling to Spanish outlet RAC1 after leaving the court.<\/p>\n<p>\u201cI am really dissatisfied with this decision,\u201d she said. \u201cWe will file an appeal because we believe it is not in accordance with the law.<\/p>\n<p>\u201cJustice is being done for the rich. It is scandalous that they free someone because they can get \u20ac1 million in no time.\u201d<\/p>\n<p>On Tuesday, Guardiola argued that there was no risk of Alves fleeing the country or destroying evidence, while the former Barcelona player appeared via video link and insisted he was not a flight risk and was prepared to hand in his passports.<\/p>\n<p>The prosecution, meanwhile, demanded a sentence of nine years, complaining that February\u2019s four and a half year conviction was not sufficient punishment for the crime committed.<\/p>\n<p>Alves was found guilty of sexually assaulting a woman in a Barcelona nightclub in 2022 following a 13-month investigation \u2014 during which time Alves remained in preventative pretrial prison \u2014 and a three-day trial last month.<\/p>\n<p>Over the course of the trial, evidence was heard from the victim\u2019s friend and cousin, Alves\u2019 friend whom he was with the night of the crime, police officers who attended to the woman and a forensic psychologist who examined her.<\/p>\n<p>Police said the victim was greatly shaken and told them she had been sexually assaulted by Alves, while the psychologist testified that she was suffering from post-traumatic symptoms, a conclusion that was disputed by an outside expert called by the defence.<\/p>\n<p><!-- AI CONTENT END 2 -->\n\t<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Dani Alves \u00a0 Former Brazil footballer Dani Alves has been granted release on bail for \u20ac1 million ($1.1m) upon appeal, a court in Barcelona, Spain, announced on Wednesday.
