{"id":138877,"date":"2024-01-14T11:57:53","date_gmt":"2024-01-14T11:57:53","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/01\/14\/scourt-spared-no-words-reversing-appeal-courts-miscarriage-of-justice-ozekhome-on-guber-disputes\/"},"modified":"2024-01-14T11:57:53","modified_gmt":"2024-01-14T11:57:53","slug":"scourt-spared-no-words-reversing-appeal-courts-miscarriage-of-justice-ozekhome-on-guber-disputes","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/01\/14\/scourt-spared-no-words-reversing-appeal-courts-miscarriage-of-justice-ozekhome-on-guber-disputes\/","title":{"rendered":"S&#8217;Court Spared No Words Reversing Appeal Court&#8217;s &#8216;Miscarriage Of Justice&#8217; \u2014 Ozekhome On Guber Disputes"},"content":{"rendered":"<p><\/p>\n<div>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-20170\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2024\/01\/Ozekhome_927254185.jpg\" alt=\"\" width=\"238\" height=\"318\"  \/><\/p>\n<p>Senior Advocate of Nigeria, Mike Ozekhome, says the Supreme Court did not hesitate to quash some of the rulings of the Appeal Court on governorship election disputes.<\/p>\n<p>According to him, the apex court used judicial \u201ckoboko\u201d to \u201cflog\u201d the appellate court while giving verdicts on the matters on Friday.<\/p>\n<p>While speaking on Arise Television on Saturday, Ozekhome said although he believes that many cases should not get to the Supreme Court, the Appeal Court\u2019s sack of Plateau lawmakers could be examined by the apex court.<\/p>\n<p>Recall that in November 2023, a Court of Appeal sitting in Abuja sacked elected members of the Peoples Democratic Party (PDP) in the Plateau assembly.<\/p>\n<p>It ruled that the \u201cPDP structure in Plateau collapsed since 2020,\u201d and as such, the Party cannot sponsor any candidate to contest an election.<\/p>\n<p>Reacting, Ozekhome said the verdict was a \u201cmiscarriage of justice.\u201d<\/p>\n<p>\u201cI was one of those who felt like the supreme court should not be bothered with too many of these; the house of assembly, house of representative, and senate (cases) could end at the appeal level, but from what we have seen particularly in the Plateau scenario, there was a great miscarriage of justice,\u201d he said.<\/p>\n<p><strong>READ ALSO: Kano Guber: \u2018No Agreement With APC But Time Will Tell\u2019 \u2014 Kwankwaso Speaks On Joining Tinubu\u2019s Govt<\/strong><\/p>\n<p>\u201cThe supreme court spared no words, they used legal and judicial koboko (cane) to flog the court of appeal for what they termed miscarriage of justice, perverse judgments.<\/p>\n<p>\u201cIn many of the cases, particularly the Plateau state, two senators\u2019 positions were reversed, three house of representative were reversed, and 11 house of assembly were reversed. If all these cases had gone to the supreme court, all of them would have their seats retained.<\/p>\n<p>\u201cOn what grounds were they reversed? The court of appeal surprisingly was saying the PDP had no structure in Plateau state. When did PDP structure, membership of a political party, nomination, congresses, and primaries become part and parcel of matters that the court can have jurisdiction?<\/p>\n<p>\u201cToday, the supreme court said not even the election tribunal has jurisdiction, let alone the court of appeal. And they voided the decision of the governorship. They would also have voided the decision on the two senatorial candidates, three house of representatives, and the 11 house of assembly.<\/p>\n<p>\u201cInjustice has been done to them. What is the remedy now?
