{"id":136678,"date":"2024-01-05T12:09:57","date_gmt":"2024-01-05T12:09:57","guid":{"rendered":"https:\/\/www.ghanamma.com\/2024\/01\/05\/acourt-didnt-give-fair-hearing-mutfwang-asks-supreme-court-to-void-sack\/"},"modified":"2024-01-05T12:09:57","modified_gmt":"2024-01-05T12:09:57","slug":"acourt-didnt-give-fair-hearing-mutfwang-asks-supreme-court-to-void-sack","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2024\/01\/05\/acourt-didnt-give-fair-hearing-mutfwang-asks-supreme-court-to-void-sack\/","title":{"rendered":"\u2018A&#8217;Court Didn&#8217;t Give Fair Hearing\u2019 \u2014 Mutfwang Asks Supreme Court To Void Sack"},"content":{"rendered":"<p><\/p>\n<div>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-full wp-image-872109\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/11\/Caleb-Mutfwang-768x599-1.jpg\" alt=\"\" width=\"768\" height=\"599\"  \/><\/p>\n<p>Governor Caleb Manasseh Mutfwang of Plateau State, has stated he was not given a fair hearing at the Court of Appeal before his election was nullified.<\/p>\n<p>Last year, March 20, the Independent National Electoral Commission (INEC) announced Mutfwang of the Peoples Democratic Party (PDP) as the winner of the governorship election in Plateau, having scored 525,299 votes, while Nentawe Yilwatda, candidate of the All Progressives Congress (APC), got 481,370 votes.<\/p>\n<p>Not satisfied with the results, Yilwatda and the APC filed a petition challenging the outcome of the election at the tribunal.<\/p>\n<p>But the petition was trashed by the tribunal.<\/p>\n<p>However, in November 2023, a three-member panel of the Appellate Court led by Elfrieda Williams-Dawodu held that Mutfwang was not validly sponsored by the PDP for the election.<\/p>\n<p>Mutfwang then filed an appeal before the apex court.<\/p>\n<p>At the hearing session on Thursday, Mutfwang said the dismissal of the seven issues he raised at the court of appeal was against the directive of the Supreme Court that intermediate courts should pronounce on all issues placed before it.<\/p>\n<p><strong>READ ALSO: Plateau: \u201cGov. Mutfwang\u2019s Sack Might Escalate To Full-Blown Crisis\u201d \u2014 PDP To CJN Ariwoola<\/strong><\/p>\n<p>\u201cEight issues were distilled and placed before the court below for determination. Unfortunately, only one issue (of jurisdiction) was determined by the court below leaving untouched seven issues,\u201d he said.<\/p>\n<p>\u201cThis court has stated in quite a number of cases that intermediate courts should pronounce on all issues placed before it. It should not restrict it to one or more issues which its opinion may dispose of the matter.<\/p>\n<p>\u201cThis is to give the apex court the benefit of their views in the matter should there be need to consider other issues not determined by the intermediate court.<\/p>\n<p>\u201cIt is our further submission that having denied fair hearing to the appellant, with respect to the notice of preliminary objection as well as a motion to strike out the incompetent grounds of appeal, the decision of the lower court to dismiss same is, with all due respect manifestly flawed,\u201d he added.<\/p>\n<p>He prayed the court to overturn the judgment of the lower court and affirm his election as State Governor.<\/p>\n<div class=\"code-block code-block-7\" style=\"margin: 8px auto; text-align: center; display: block; clear: both;\">\n<div data-advadstrackid=\"890536\" data-advadstrackbid=\"1\" class=\"infor-target\" id=\"infor-1276255149\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/12\/300x250b.gif\" alt=\"\" width=\"300\" height=\"250\"\/><\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Governor Caleb Manasseh Mutfwang of Plateau State, has stated he was not given a fair hearing at the Court of Appeal before his election was nullified.
