According to latest report by Adom FM, the Supreme Court has dismissed a legal objection raised against the National Democratic Congress (NDC) regarding its request to overturn a High Court decision for the re-collation of parliamentary election results in six constituencies.
On Friday, December 27, 2024, Gary Nimako Marfo, the lawyer representing the New Patriotic Party (NPP) parliamentary candidates for the affected constituencies, challenged the NDC’s application. He argued that the NDC had failed to attach the High Court ruling to its application, which he claimed violated court rules. Due to this omission, he asked the Supreme Court to reject the NDC’s request.
However, the Supreme Court, made up of five judges led by Justice Gabriel Pwamang, rejected this argument. The panel, which also included Justices Henrietta Mensa-Bonsu, Eric Gaewu, Henry Kwofie, and Richard Adjei-Frimpong, stated that the NDC later submitted the required ruling as a supplementary affidavit.
Because of this, the court chose to overlook the earlier mistake and decided to allow the case to continue. This means the NDC’s application will be reviewed, despite the initial error.
After hearing arguments from the NDC’s lawyer, Godwin Edudzi Tameklo, the Electoral Commission’s lawyer, Justine Amenuvor, and the NPP’s lawyer, Gary Nimako Marfo, the Supreme Court retired to deliberate on its final decision.
The NDC is challenging the results of the parliamentary elections in six constituencies. They believe errors occurred during the collation process and want the results reviewed. The High Court had earlier ordered the re-collation of votes, but the NDC is seeking to stop this process through the Supreme Court.
