Her lawyer said the crash was Mr Sanderson\u2019s fault and his claims are \u201cutter BS\u201d.<\/p>\n<p>Mr Sanderson, 76, is seeking damages of $300,000 (\u00a3245,000).<\/p>\n<p>He dropped a previous claim for $3.1m.<\/p>\n<p>The 50-year-old Oscar winner\u2019s counterclaim seeks $1 in damages, plus legal fees.<\/p>\n<p>The actress-turned-lifestyle-influencer sat impassively in court during opening statements on the first day of the trial in a Park City court on Tuesday.<\/p>\n<p>The incident occurred in February 2016 on the beginners\u2019 slope at the Deer Valley resort where Ms Paltrow was skiing with her family.<\/p>\n<p>She and her children are expected to testify.<\/p>\n<figure class=\"wp-block-image\"><img class=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/03\/_129072661_gettyimages-1249006299.jpg\" alt=\"Paltrow in court\" title=\"'Reckless' Gwyneth Paltrow caused Utah ski crash, lawyer says\"\/><figcaption class=\"wp-element-caption\">(Getty Images)<\/figcaption><\/figure>\n<p>\u201cDistracted skiers cause crashes,\u201d said Mr Sanderson\u2019s attorney, Lawrence Buhler.<\/p>\n<p>\u201cShe knew that skiing that way, blindly skiing down a mountain while looking up and to the side, was reckless; she knew that continuing to ski that way\u2026 she would crash into somebody below her.\u201d<\/p>\n<p>Mr Buhler said Ms Paltrow crashed into his client and then quickly skied away, leaving him prone and unconscious without calling for help or checking to make sure he was OK.<\/p>\n<p><iframe loading=\"lazy\" width=\"400\" height=\"500\" frameborder=\"0\" src=\"https:\/\/www.bbc.com\/news\/av-embeds\/65027945\/vpid\/p0fb2vkl\"><\/iframe><\/p>\n<p>\u201cBefore this crash, Terry was a charming, outgoing, gregarious person,\u201d Mr Sanderson\u2019s lawyer said.<\/p>\n<p>\u201cHe was living a full life, travelling the world \u2013 doing everything possible to enjoy his life and guard his health. But after the crash, he\u2019s no longer charming.\u201d<\/p>\n<p>Steve Owens, Ms Paltrow\u2019s lawyer, dismissed Mr Sanderson\u2019s claims as \u201cutter BS\u201d.<\/p>\n<p>He told the jury his client had just begun descending the slope when a pair of skis suddenly appeared between her legs and a man collided into her back.<\/p>\n<figure class=\"wp-block-image\"><img class=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/03\/_129078457_gettyimages-1249006101.jpg\" alt=\"Terry Sanderson accuses Ms Paltrow of being distracted while skiing\" title=\"'Reckless' Gwyneth Paltrow caused Utah ski crash, lawyer says\"\/><figcaption class=\"wp-element-caption\">Terry Sanderson accuses Ms Paltrow of being distracted while skiing (Getty Images)<\/figcaption><\/figure>\n<p>Ms Paltrow\u2019s lawyer argued that Mr Sanderson, who suffers from vision and hearing loss as a result of a previous stroke, may not have seen the actress before he collided with her.<\/p>\n<p>Mr Owens said his client initially suspected she was being assaulted and was so shaken by the incident she chose not to ski for the rest of the day.<\/p>\n<p>\u201cShe may have sworn at him. It rattled her and it physically hurt her,\u201d he said.<\/p>\n<p>The case appears to hinge on which skier \u2013 Ms Paltrow or Mr Sanderson \u2013 was uphill at the time of the accident. According to\u00a0Deer Valley safety policies, skiers \u201cahead or downhill of you have the right of way. You must avoid them.\u201d<\/p>\n<p>Craig Ramon, who is a friend of Mr Sanderson, was the first witness to take the stand in the case.<\/p>\n<figure class=\"wp-block-image\"><img class=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/03\/_129072666_gettyimages-1249006091.jpg\" alt=\"At times Ms Paltrow attempted to hide from the cameras in court\" title=\"'Reckless' Gwyneth Paltrow caused Utah ski crash, lawyer says\"\/><figcaption class=\"wp-element-caption\">At times Ms Paltrow attempted to hide from the cameras in court (Getty Images)<\/figcaption><\/figure>\n<p>He testified that he heard a scream and turned his head to see Ms Paltrow crash into Mr Sanderson.<\/p>\n<p>But on cross-examination, Ms Paltrow\u2019s lawyers noted that Mr Ramon is colour-blind, arguing he could not have distinguished which skier caused the crash from his or her clothing alone.<\/p>\n<p>Ms Paltrow\u2019s lawyers allege that GoPro footage and a social media post that corroborate her version of events have \u201cdisappeared\u201d.<\/p>\n<p>The original claim, filed in 2019, said: \u201cThis case involves a hit-and-run ski crash at Deer Valley, Utah, where defendant Gwyneth Paltrow skied out of control and hit the back of Terry Sanderson, another skier, who was downhill, knocking him down hard, knocking him out, and causing a brain injury, four broken ribs and other serious injuries.\u201d<\/p>\n<p>The proceedings are scheduled to last for eight days.<\/p>\n<p><strong>DISCLAIMER: <\/strong>The Views, Comments, Opinions, Contributions and Statements made by Readers and Contributors on this platform do not necessarily represent the views or policy of Multimedia Group Limited.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Gwyneth Paltrow was \u201cdistracted\u201d when she crashed into a retired eye doctor on a ski slope, inflicting brain damage and breaking his ribs, a court heard.
