While speaking about the said petition in an interview with Arise TV, Peter Obi\u2019s running mate, Yusuf Datti Baba-Ahmed said going by section 134 of the Nigerian Constitution, Bola Tinubu can\u2019t be sworn in as president.<\/p>\n<p>According to Baba-Ahmed \u201cWe are not just talking about losing the election, we are now talking about a constitutional breach. Where you have a constitutional breach, there is no president-elect. I beg to say that by the standard meaning of section 134, we do not have a president-elect in Nigeria today. You cannot swear in a president whose certificate of return assaults the Constitution because the constitution is the platform on which the presidency rests\u201d. <\/p>\n<p>Explaining what section 134 of the Constitution is all about, Baba-Ahmed said \u201d Section 134 says the president shall have scored 25 percent in at least two-thirds of the state of the federation and the Federal Capital Territory, Abuja and it could not be any clearer than this. The Constitution is not a puzzle to be solved, it is a document to be followed. Right now, technically and Constitutionally speaking we don\u2019t have a president-elect by the standard definition of section 134.
