The judges were requested to provide a stay for a minimum of 45 days.<\/p>\n<p style=\"font-weight: 500 !important;\"><span style=\"font-weight: 500 !important;\"><em>\u201cIn those 45 days, I urge you to suspend the oppression of those particular findings in the judgement and any decree that may flow therefrom pending the filing of a formal application under the Mutunga Rules and the Court of Appeal Rules,\u201d<\/em> said the respondents through lawyer George Murugara.<\/span><\/p>\n<p style=\"font-weight: 500 !important;\"><em><span style=\"font-weight: 500 !important;\">\u201cThe reason is that, first, we have to make the necessary adjustments to the government procedure of taxation so that no party\/arm of government is sued for contempt.\u201d<\/span><\/em><\/p>\n<p>Justices Majanja, Christine Meoli, and Lawrence Mugambi concluded that they do not hold the final authority on the matters at hand.<\/p>\n<figure id=\"attachment_303667\" aria-describedby=\"caption-attachment-303667\" style=\"width: 774px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-303667 size-full\" alt=\"\" width=\"774\" height=\"425\"  data-lazy- src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/11\/maja.jpg\"\/><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-303667 size-full\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2023\/11\/maja.jpg\" alt=\"\" width=\"774\" height=\"425\"  \/><figcaption id=\"caption-attachment-303667\" class=\"wp-caption-text\">Justice David Majanja during the ruling on Finance Act, 2023 on November 28, 2023.<\/figcaption><\/figure>\n<p><em>\u201cWe have no doubt this court has jurisdiction to grant orders of stay pending appeal even after declaring a certain decision unconstitutional,\u201d<\/em> Justice David Majanja said.<\/p>\n<p><em>\u201cThe respondents are also entitled to exercise the right of appeal, to the court of appeal and even the Supreme Court.
