A Nyamira county law court has reportedly ordered the sacking of Hon Dolphine Nyangara, a nominated MCA under the top-up category in the Nyamira County Assembly.
This comes weeks after a petition was filed by one Mitchell Kemuma who challenged the nomination of Dolphine.
According to reports, Mitchell had argued that the Independent Electoral Boundaries Commission (IEBC) led by Wafula Chebukati used a wrong list of nominees that led to Dolphine’s appointment.
In her petition, she informed that Dolphine was a resident in Kahawa Wendani Ward and also a registered voter in Kiambu county. On that note, the petitioner argued that it would be unfair for her to lead the people of Nyamira yet she barely understands their challenges.
In a statement, the Court ruled in Mitchell Kemuma’s favour, stating that the nomination of Dolphine Nyangara is indeed illegal and should therefore be overturned.
Further, the court reportedly ordered immediate replacement of the MCA, a process that needs to be conducted by the IEBC as well as the Registrar of Political Parties.
