{"id":974180,"date":"2022-02-02T23:09:29","date_gmt":"2022-02-02T23:09:29","guid":{"rendered":"https:\/\/www.ghanamma.com\/2022\/02\/02\/court-to-hear-case-filed-by-300-sacked-nandi-county-workers\/"},"modified":"2022-02-02T23:09:29","modified_gmt":"2022-02-02T23:09:29","slug":"court-to-hear-case-filed-by-300-sacked-nandi-county-workers","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2022\/02\/02\/court-to-hear-case-filed-by-300-sacked-nandi-county-workers\/","title":{"rendered":"Court to hear case filed by 300 sacked Nandi County workers"},"content":{"rendered":"<p><\/p>\n<div>\n<figure>\n<div class=\"art-img row mx-md-0\">\n<img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2022\/02\/mtuxcuhehurmhypybi61fada7b907db.jpg\" class=\"img-fluid w-100\" width=\"800\" height=\"500\"\/><\/div><figcaption class=\"bg-light mb-3 p-3 row mx-md-0\">\n<p><strong>Nandi Governor Stephen Sang. <\/strong>[David Njaaga, Standard]\n<\/p>\n<\/figcaption><\/figure>\n<p class=\"card-text\">A court in Kapsabet has rejected an application by Nandi County government seeking to stop the hearing of a petition filed by over 300 support staff who were sacked.\n<\/p>\n<p>After the workers failed to appear for mentions in two consecutive sessions, the county told the court that the matter was still pending in the Senate for determination. <\/p>\n<p>Lawyer Nathan Tororei, who represented the County Public Service Board, told Kapsabet Resident Magistrate Samuel Mbugua that the Senate had not concluded hearing the dispute.\n<\/p>\n<p>He argued that the court and the Senate could not have parallel proceedings to settle the dispute.<\/p>\n<p>Mr Tororei told the court that the Senate Committee on Health was yet to issue its verdict.\n<\/p>\n<p><strong>Senate case<\/strong>\n<\/p>\n<p>\u201cThe plaintiffs had presented the case to the Senate and it\u2019s still active pending determination after hearing of their submissions last year,\u201d he said. <\/p>\n<p>The support staff, including cleaners and ground personnel, were dismissed in June 2020 after working for two years without receiving their dues as laid out in their contracts.\n<\/p>\n<p>They accused the county of revoking their appointment and terminating a three-year contract, and are now demanding their dues and gratuity amounting to over Sh1 million.\n<\/p>\n<p>Mr Mbugua dismissed the county\u2019s arguments, saying that the Senate has no substantive mandate to resolve workers\u2019 issues, and affirmed that the court would proceed with hearing the matter.\n<\/p>\n<p>\u201cJudiciary and the Senate are two independent institutions, and it cannot interfere with the court proceedings,\u201d he said.\n<\/p>\n<p>The plaintiffs will submit their evidence to the court during the hearing of the case that is scheduled for May 23.\u00a0 <\/p>\n<div class=\"justify-content-start\">\n<button class=\"tags-btn mr-4 mb-3 load-more\"><br \/>\nNandi County<br \/>\n<\/button><br \/>\n<button class=\"tags-btn mr-4 mb-3 load-more\"><br \/>\nSupport Staff<br \/>\n<\/button>\n<\/div>\n<\/div>\n<p><a href=\"https:\/\/www.standardmedia.co.ke\/article\/2001436342\/court-to-hear-case-filed-by-300-sacked-nandi-county-workers\">Source: The Standard Media Kenya<\/a> <a \"><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Nandi Governor Stephen Sang.
