The Lighthouse Chapel International\u00a0(LCI) has filed\u00a0three applications\u00a0for judgment in default of\u00a0defence against Manasseh Azure, Edwin Appiah,\u00a0Sulemana Braimah and Media Foundation for West Africa in\u00a0connection with\u00a03\u00a0separate defamation suits it filed against the defendants.<\/p>\n
The suits are in respect of 3 articles the defendants published against the Church titled \u2018\u2019Darkness in a Lighthouse\u2019\u2019\u00a0in April last year.<\/p>\n
The writ issued by Kweku Paintsil , counsel for the the Church, in its Statements of Claim avers that Manasseh Azure and the 3 others together published the three articles in which they launched scathing and disparaging attacks on the LCI and its founder Bishop Dag\u00a0Heward-Mills.<\/p>\n
Some of the defamatory publications according to the statements of claim included the allegations that \u201csix ministers of God laboured for a cumulative 42 years and five months without the payment of their pension contributions \u2026 \u201d ( by the church)<\/p>\n
Another publication complained of by the church was the allegation that the \u00a0exploitation by the church, undue pressure , and psychological effects of the ordeals by pastors drove an aggrieved former pastor of the church named Seth Duncan to \u201cattempt suicide three times and also cut his scrotum\u201d.<\/p>\n
The statements of claim also avers that the articles apart from being defamatory, were also highly prejudicial to six (6) suits that have been brought against the church by 6 of its former pastors, and further that the publications constituted a media trial of the suits in favour of the 6 former pastors.<\/p>\n
Default Judgement<\/p>\n
The motion papers for the judgment in default of defence state that the court will be moved January 24, 2022, by \u201ccounsel for and on behalf of the Plaintiff\/Applicant on the hearing of an application on the part of the Plaintiff\/Applicant for an order that no defence having been delivered by the 1st \u2013 4th Defendants\/Respondents herein, Interlocutory Judgment be entered for the Plaintiff\/Applicant against the 1st \u2013 4th Defendants\/Respondents for the reliefs endorsed on the Writ of Summon.\u201d<\/p>\n
According to the motion papers, the applications for judgment in default of defence are grounded on Order 13 rule 6(1) of the High Court (Civil Procedure Rules), 2004, C.I. 47 which states that \u201cWhere the plaintiff makes against a defendant a claim of a description not mentioned in rules 1 to 4 and the defendant fails to file a defence to the claim, the plaintiff may, after the expiration of the period fixed by these Rules for filing the defence, apply to the Court for judgment.\u201d<\/p>\n
According to the affidavits in support of the applications for default judgment, \u201c On 10th December 2021, the Plaintiff issued a Writ of Summons with an accompanying Statement of Claim seeking against the Defendants the various reliefs endorsed on the Writ of Summons.<\/p>\n
It avers that the Defendants entered appearance to the suit on 20th December, 2021, but have failed to deliver their defences to date according to a search conducted at the registry of the court.<\/p>\n
\u201cI am advised that the Plaintiff has become entitled to judgment for the reliefs endorsed on the Writ of Summons by reason of the said default\u201d, it added.<\/p>\n
Counsel for the defendants, Mr. Samson Lardy Anyenini, been served with the three applications for judgment in default of defence and he has until January 24, 2022, to respond to them.<\/p>\n
Reliefs Sought<\/p>\n
Damages, including special, aggravated and exemplary damages for libel contained on websites published by the Defendants herein and re-published by many local and international media.<\/p>\n
An\u00a0injunction restraining the Defendants and each of them, whether by themselves, their servants, or agents or otherwise, from further\u00a0publishlng\u00a0or causing to be published the said or similar words defamatory of the Plaintiff.<\/p>\n
An order directed to the Defendants to publish with equivalent prominence to the same medium a suitable apology in terms to be agreed by the parties or approved by the Plaintiff and for the same to be archived on Defendants\u2019 website so as to remain searchable to users of the said website and Facebook accounts.<\/p>\n
An\u00a0order directed to the Defendants to ensure the removal of the defamatory articles as well as their re-publication on other media sites from the internet.<\/p>\n
