The truth can not be hidden for long. The truth is like a pregnancy; it would eventually be found out.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/www.ghanamma.com\/wp-content\/uploads\/2022\/08\/95c673b17c20433aa3588bb71b10ebe5\"\/><\/p>\n<p>It is not surprising that the Member of Parliament and Majority Leader openly expressed his thoughts on the duties of the Member of Parliament. Honourable Osei Kyei-Mensah Bonsu explained that the MP&#8217;s work is not to build roads. He revealed he can facilitate but that should not be misconstrued.<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/www.ghanamma.com\/wp-content\/uploads\/2022\/08\/e370e4ad12304a9491cb21b40cacf444\"\/>Interestingly, Prof. John Gatsi has written a piece on the fact that Kenya&#8217;s <span style=\"color: rgb(5, 5, 5);\">MP Common Fund has been declared unconstitutional on separation of powers grounds. <\/span><\/p>\n<p><span style=\"color: rgb(5, 5, 5);\">According to Professor Gatsi, <\/span>The Kenyan Supreme Court is saying, in effect, that executing public projects or delivering public services through the expenditure of public funds is an executive, not a legislative function or a legislator&#8217;s job.<\/p>\n<p>The CDF&#8217;s Ghana equivalent, which is a practice that is not even backed by legislation, is even more clearly unconstitutional, but who cares!<\/p>\n<p><img decoding=\"async\" src=\"http:\/\/www.ghanamma.com\/wp-content\/uploads\/2022\/08\/db74dcbefd884aeaacb73c7b88b22760\"\/><\/p>\n<p>The Finance Professor John Gatsi also made reference to the fact that; &#8220;A bench of five judges led by Chief Justice Martha Koome ruled that the CDF Act  the principle of separation of powers, hence is unconstitutional.&#8221;<\/p>\n<p>As it was reported, &#8220;Each constituency receives at least Sh100 million every year and the legislators have used the kitty for community development projects.&#8221;<\/p>\n<p>Per the ruling, the judges  Justice Koome, Kenya&#8217;s Deputy Chief Justice, Philomena Mwilu, Smokin Wanjala, Njoki Ndung&#8217;u and William Ouko said: \u201cA fund directed at service delivery mandate can only be constitutionally complaint if structured in a manner that does not entangle members of Legislative bodies and Legislative bodies in the discharge of the service delivery mandate however symbolic&#8221;.<\/p>\n<p>What are your thoughts on the ongoing discussion?
