Lawyer and KPMG Professor in Accounting at the Fisher School of Accounting, University of Florida Stephen Kwaku Asare widely known as Kwaku Azar\u00a0has expressed his profound disappointment that seniority and threats have reared its head in this simple matter of the Council of State member\/GPHA Director, aided by top GRA officials, cheating on taxes as revealed by the Special Prosecutor.<\/p>\n

In a post shared on his official Facebook page on Wednesday, 10th August 2022, he wrote;<\/p>\n

“The issues are: (1) whether the applicant and transactions qualified for applying for a customs advanced ruling (CAR);<\/p>\n

(2) what is the legal basis for issuing the CAR, which reduced the benchmark values;<\/p>\n

(3) whether, under the law, Mr. Adu had the power to issue the CAR?<\/p>\n

(4) why the customs technical service bureau(CTSB) negative advice on the application was ignored or set aside;<\/p>\n

(5) how the application was resuscitated after the negative advice;<\/p>\n

(6) whether the CAR was brought to the notice of the Commissioner General; and (7) whether there is influence peddling.”<\/p>\n

Kwaku Azar also asserted these are serious issues that belong to a judicial forum constituted to determine whether there is corruption and corruption related tax evasion, especially as the implicated parties are politically exposed persons.<\/p>\n

Prof Azar called for an expanded inquiry into the affected \u2019s customs related activities, indictment of affected officials pending the resolution of the facts, assessment of interest and penalties, and the usual presumption of innocence .<\/p>\n
