{"id":1113530,"date":"2022-06-07T15:09:30","date_gmt":"2022-06-07T15:09:30","guid":{"rendered":"https:\/\/www.ghanamma.com\/2022\/06\/07\/top-gun-maker-sued-over-copyright-breach\/"},"modified":"2022-06-07T15:09:30","modified_gmt":"2022-06-07T15:09:30","slug":"top-gun-maker-sued-over-copyright-breach","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2022\/06\/07\/top-gun-maker-sued-over-copyright-breach\/","title":{"rendered":"Top Gun maker sued over copyright breach"},"content":{"rendered":"<p><\/p>\n<div>\n<div class=\"td-post-featured-image\">\n<figure><img loading=\"lazy\" decoding=\"async\" width=\"696\" height=\"392\" class=\"entry-thumb\" src=\"https:\/\/www.ghanamma.com\/wp-content\/uploads\/2022\/06\/Top-Gun-maker-sued-696x392.jpg\"   alt=\"\" title=\"Top Gun maker sued \/ Credit: PARAMOUNT PICTURES\"\/><figcaption class=\"wp-caption-text\">Top Gun maker sued \/ Credit: PARAMOUNT PICTURES<\/figcaption><\/figure>\n<\/div>\n<p>The family of the Israeli writer whose article inspired the 1986 Tom Cruise movie Top Gun is suing film studio Paramount Pictures for copyright infringement over its sequel.<\/p>\n<p>They claim the studio did not have the rights to Ehud Yonay\u2019s 1983 story \u201cTop Guns\u201d when it released the sequel Top Gun: Maverick last month.<\/p>\n<p>The film earned $548m (\u00a3438m) globally in its first 10 days of release.<\/p>\n<p>Paramount says the claim was \u201cwithout merit\u201d and vowed to contest it.<\/p>\n<p><!-- \/22191989129,1002554\/MGL\/mgl_ado_atunwa_300x250 --><\/p>\n<p>Top Gun: Maverick sees Cruise reprise his role as US navy pilot Pete \u201cMaverick\u201d Mitchell from the original 1986 film.<\/p>\n<p>It had the fourth biggest opening weekend of any film in the Covid-era, behind the best-selling Spider-Man: No Way Home, second-place Doctor Strange in the Multiverse of Madness and then The Batman.<\/p>\n<p>The lawsuit \u2013 filed on Monday at the Los Angeles federal court by Shosh and Yuval Yonay, Ehud\u2019s widow and son \u2013 alleges that Paramount failed to reacquire the rights to Ehud\u2019s magazine article after it was terminated under the US Copyright Act.<\/p>\n<p>They are seeking unspecified damages from the film studio, including profits from Top Gun: Maverick.<\/p>\n<p>According to the lawsuit, Paramount\u2019s Top Gun franchise would not have existed without Ehud\u2019s \u201cliterary efforts and evocative prose and narrative\u201d.<\/p>\n<p>The lawsuit said that in 2018, the Yonays informed Paramount that its rights to Ehud\u2019s article would be terminated two years later.<\/p>\n<p>It added that the studio lost the copyright for the piece in January 2020.<\/p>\n<p>\u201cMuch as Paramount wants to pretend otherwise, they made a sequel to Top Gun after they lost their copyright,\u201d lawyer Marc Toberoff, who is representing the Yonays, told the BBC.<\/p>\n<p>Paramount said in a statement: \u201cThese claims are without merit, and we will defend ourselves vigorously.\u201d<\/p>\n<p>Mitra Ahouraian, a Los Angeles-based entertainment attorney, told the BBC that Paramount\u2019s plans to produce Top Gun: Maverick in 2018 and release it in 2019 were delayed because of the Covid-19 pandemic.<\/p>\n<p>\u201cTiming is going to be very important in this case because the notice of termination was sent\u2026 to have an effective date of 2020,\u201d Ms Ahouraian explained.<\/p>\n<p>The sequel sees Maverick return to the Top Gun flying academy as an instructor in charge of training a new generation of pilots.<\/p>\n<p>It gave Hollywood superstar Cruise his first $100m (\u00a380m) opening weekend at the box office.
