Twelve (12) persons arrested and airlifted to Accra for their involvement in the recent Bawku chieftaincy clashes, which led to the loss of lives and destruction of property have been granted bail in the sum of Ghs240,000 by an Accra High Court.
Each of the 12 accused persons was granted bail in the sum of Ghs20,000 with one surety.
They would be making their next court appearance on February 12, 2022.
They have been slapped with charges of unlawful assembly with weapons and offensive conduct conducive to the breach of the peace.
The 12 accused persons are Issahaku Barkin, Samuel Abduo Rahman, Seidu Mohammed Saani, Richard Amevor, Nantogma Kwami and Iddrisu Shaibu, Namaw Osman Nabia, Inusah Belko, Abdulai Gboo, Abdulai Nangbon Dana, Naa Tampuri and Dr Samuel Burgri.
They had on Thursday, January 6, been denied bail when the appeared before an Accra Circuit Court, presided over by Mr. Emmanuel Essandoh.
The circuit court said it lacked the jurisdiction to grant the accused persons bail.
The presiding judge stated that the matter before him had to do with fundamental human rights, something outside the court’s jurisdiction.
It is only the High Court that has jurisdiction to hear the bail application.
Their lawyer, Martin Kpebu, had argued that keeping the 12 persons for more than nine days was a constitutional infraction.
This was countered by a Senior State Attorney, Ms. Vivian Osei Tutu, who said once the case was before the High Court, the circuit court was disabled from dealing with it in any way.
She said although there was no dispute about the fact that the 12 persons had been held for more than 48 hours, a proper court was required to handle the matter.
Ms. Vivian Osei Tutu added that the 12 accused persons if granted bail would jump bail, given the fact that the offense they have been accused of was committed when a curfew was in place and there was a court restraining order that they should not organize the funeral of the late chief of Bawku.
