Removal Of The President: Akufo-Addo To Be Removed By Less Than One-Third Of Parliament?

Concerning e-levy and the removal of the president on the alleged case with Serwaa Broni, here’s what lawyer Ralph Agyapong had to say:

Article 69, clause 1:

The president is to be removed if he is found acting in different accordance that could disrupt the ruling of the presidency, presidential oath, or unlawful violation of any other provision of the constitution.

Article 69, clause 2 (removal of the president):

A notice is to be written and signed by at least one-third of the parliament.

“When I heard that Godwin Edudzi Tamakloe is going to put an injunction on e-levy, I laughed. You can’t injunct a law that has been signed. It is not in the constitution.”

“You can go and seek whether or not it is constitutional or unconditional but you can’t injunct it”

“With the case of impeaching and people wanting to remove the president is a one-sided story. If you go into article 69 clause 2, they can initiate that proceedings but the Chief Justice will have to come in and appoint 4 senior Supreme Court members himself to ascertain whether there’s a prima facie on the face of the evidence if there are facts to be answered to”

Thus, even after the case is presented to parliament, it is not straight up that the president is removed by one-third of them, but there are factual answers to be given before any final decision is made.
