The Difference Between A Lawyer And An Advocate

Over the years, distinguishing between a lawyer and an advocate has always been a problem to many people and, undoubtedly, you included. When people are facing legal issues, they sometimes fail to understand whether they need an advocate or a lawyer. Let’s start by understanding who a lawyer is.

Now, using the simplest terms possible, a lawyer is anyone studying law or anyone with bachelors degree in law (LLB). In essence, the term lawyer is just a general term used to address people in the law profession. Worth noting is the fact that lawyers are not allowed to represent clients in the courtroom. They are, however, hired to give advice on legal matters. Their knowledge, skills and experience on litigation matters is very shallow and limited.

On the other hand, an advocate is a lawyer who has been admitted to the bar after passing the bar examination. For that reason, advocates are considered knowledgeable, skilled and competent in matters law. He/she can represent a client in the court of law, plead for client’s release, avoidance of jail term and compensation where necessary. He/she can argue on behalf of the client, ask, receive and answer questions on behalf of the client.

Admission to the bar.

Law graduates are required to enroll for the Postgraduate Diploma in Legal Practice at the Kenya School of Law. After successfully completing this level, they sit for the bar examination. Upon satisfying the examiners they are now admitted to the bar.
