trial of Dr Stephen Opuni, the former CEO of<br \/>\nCOCOBOD and Seidu Agongo, the CEO of Agricult Ghana Limited, has struck out<br \/>\nAttorney-General\u2019s affidavit in opposition against a motion of perjury filed by<br \/>\none of the accused.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Mr Samuel Cudjoe,<br \/>\nthe Counsel for Dr Opuni has cited Dr. Yaw Adu-Ampomah, the third prosecution<br \/>\nwitness in the trial for perjury.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">When the case was<br \/>\ncalled on Thursday, Mr Cudjoe objected to the affidavit in opposition filed by<br \/>\nthe State for the respondent Dr Adu-Ampomah.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">The witness, who is<br \/>\na Former Deputy Chief Executive Officer at COCOBOD in Charge of Agronomy and<br \/>\nQuality Control, had in his evidence-in-chief, in May 2019, told the court the<br \/>\nprocurement practice at COCOBOD for fertilizers had always been by open tender.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">This, he said, were<br \/>\ndone through advertisement in the newspapers, where the product required was<br \/>\nspecified, and interested companies, whose products have been tested and<br \/>\ncertified by Cocoa Research Institute of Ghana, were required to support their<br \/>\nbids with documents.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Whilst the trial was<br \/>\non going, Mr Cudjoe pointed out at least 18 contract documents which were<br \/>\nsole-sourced at COCOBOD under the signature of Mr Adu-Ampomah.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">The witness however<br \/>\nstood his grounds and maintained that COCOBOD always engaged in competitive<br \/>\ntender and that sole sourcing can also be used to procure fertilizers at<br \/>\nCOCOBOD.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Mr Cudjoe in his<br \/>\nobjection said the State had no right to file an affidavit in opposition on<br \/>\nbehalf of the respondent and that it was unconstitutional and breaches the<br \/>\nstatus quo.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">He said the<br \/>\nrespondent should be made to engage his own lawyer to respond to the motion. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">\u201cWe are objecting to<br \/>\nthe A-G representing the respondent in a quasi-criminal application such as the<br \/>\napplication for the perjury,\u201d he said.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">He said it was their<br \/>\nsubmission that, the A-G representation or filing affidavit in opposition breaches<br \/>\nArticle 88 (3) of the 1992 Constitution.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">He said he was<br \/>\nunaware of the respondent\u2019s filing of an affidavit in opposition but rather<br \/>\nsought to rely on the A-G\u2019s own and that the A-G could not work against the<br \/>\nrepublic.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Mrs Stella<br \/>\nOhene-Appiah, Principal State Attorney in her response said the A-G was<br \/>\nrepresenting as an interested party and not for the respondent.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">She said they were<br \/>\nduly served as an interested party and that has been indicated in paragraph<br \/>\nthree of the affidavit in opposition. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">\u201cIt is our<br \/>\nunderstanding that the respondent can aligned himself with our affidavit,\u201d she<br \/>\nadded.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">It was on these<br \/>\naugments that Justice Clemence Honyenugah, an Appeal Court Judge, sitting as an<br \/>\nadditional High Court Judge struck out the affidavit in opposition filed by A-G<br \/>\non December 20, 2019.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">He urged the<br \/>\nrespondent to consult a lawyer to file the necessary documents to respond to<br \/>\nthe perjury allegations.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Meanwhile, Nutifafa<br \/>\nNutsukpui, who held brief for Benson Nutsukpui, Counsel for Agongo, commenced a<br \/>\ncross examination of Dr Adu-Ampomah.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Mr Nutsukpui asked<br \/>\nthe witness, whether it was his evidence that in 2014 COCOBOD procured 700, 000<br \/>\nlitres of liquid Lithovit fertilizer from Agricult Ghana Limited and he<br \/>\nanswered in the affirmative.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">\u201cIs it your case that<br \/>\nin 2015, COCOBOD bought one million litres of the same product from Agricult<br \/>\nGhana Limited,\u201d he asked and the witness again answered in the affirmative.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">The court adjourned<br \/>\nthe trial to January 21 and the hearing of the perjury to January 28.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">Dr Opuni and Mr<br \/>\nAgongo are facing 27 charges, including defrauding by false pretenses, wilfully<br \/>\ncausing financial loss to the state, money laundering, corruption by public<br \/>\nofficer and acting in contravention of the Public Procurement Act.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align:justify\"><span lang=\"EN-GB\" style=\"font-size:11.0pt;font-family:&quot;Tahoma&quot;,&quot;sans-serif&quot;\">They have
