{"id":770857,"date":"2019-12-24T10:39:15","date_gmt":"2019-12-24T10:39:15","guid":{"rendered":"https:\/\/ghana-mma.com\/2019\/12\/24\/auditor-general-punched-again\/"},"modified":"2019-12-24T10:39:15","modified_gmt":"2019-12-24T10:39:15","slug":"auditor-general-punched-again","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/12\/24\/auditor-general-punched-again\/","title":{"rendered":"Auditor General Punched Again &#8211;"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>Daniel Yaw Domelevo<\/strong><\/p>\n<p>An<br \/>\nAccra High Court has set aside the decision by the Auditor General, Daniel<br \/>\nDomelevo, to disallow and surcharge a construction company based on its audit<br \/>\nreport.<\/p>\n<p>The Auditor<br \/>\nGeneral had disallowed and surcharged Joshob Construction Company Limited a<br \/>\ntotal of GH\u00a211,777,823.40 which is its IPC 10 pending payment.<\/p>\n<p>Not<br \/>\nsatisfied with the decision, the company took the Auditor General to court to<br \/>\nappeal his decision to disallow and surcharge it.<\/p>\n<p>Interestingly,<br \/>\nthe Auditor General, in his written address to the court, conceded to the<br \/>\ncontent of the appeal.<\/p>\n<p>The<br \/>\ncourt, presided over by Justice Anthony Kofi Abada in his judgment, reversed<br \/>\nand annulled the Auditor General\u2019s report and ruled in favour of the appellant,<br \/>\nJoshob Company Ltd.<\/p>\n<p>\u201cThis<br \/>\nis an appeal against the defendant decision contained in a report dated 23rd<br \/>\nJanuary, 2018 delivered by Mr. Daniel Yaw Domelevo on the respondents<br \/>\ndisallowance and surcharge of appellant\u2019s claims respecting IPC No 10, 11 and 12<br \/>\nwhich were pending payment. The defendant\/respondent have conceded per their<br \/>\nletter dated and filed on 17th April, 2018 IPC No 10, 11 and 12. I shall<br \/>\naccordingly allow the appeal to set aside the purported claims of the<br \/>\ndefendant\/respondent,\u201d the court ruled.<\/p>\n<p>The<br \/>\ncourt subsequently ordered the Ministry of Finance, Department of Urban Roads and<br \/>\nor the Controller and Accountant General to pay the total sum of GH\u00a211,772,823.40<br \/>\nto the appellant.<\/p>\n<p>The<br \/>\ncourt also awarded a cost of GH\u00a25,000 against the Auditor General.<\/p>\n<p><strong>Second Loss<\/strong><\/p>\n<p>This is<br \/>\nthe second appeal that has been ruled against the decision of the Auditor<br \/>\nGeneral to disallow and surcharge individuals and companies.<\/p>\n<p>Another<br \/>\nAccra High Court presided over by Justice Georgina Mensah-Datsa in October this<br \/>\nyear nullified the audit findings against former Chief Executive of the<br \/>\nNational Health Insurance Authority (NHIA), Sylvester Mensah, and his deputy,<br \/>\nAlex Nartey.<\/p>\n<p>According<br \/>\nto the judge, the audit and notice of certification and specification of<br \/>\ndisallowance and surcharge against the former NHIA bosses did not follow the<br \/>\nnecessary proceedings, rendering it null and void.<\/p>\n<p><strong>Other Cases<\/strong><\/p>\n<p>There<br \/>\nare other cases pending before other courts which are challenging the decision<br \/>\nof Mr. Domelevo to wrongly disallow and surcharge some government officials and<br \/>\nprivate companies.<\/p>\n<p>They<br \/>\nargued that the methods used by the current Auditor General are unknown to<br \/>\naudit practices.<\/p>\n<p>Prominent<br \/>\namong those cases is that of Zoomlion Ghana Limited which is challenging the<br \/>\ndecision of the Auditor General to disallow and surcharge the private company<br \/>\nGH\u00a2184 million over contracts it said it had executed for the NHIA through the<br \/>\nMinistry of Health (MoH).<\/p>\n<p>Senior<br \/>\nMinister Yaw Osafo-Maafo has also gone to court appealing against the decision<br \/>\nof the Auditor General to surcharge him and four others over $1 million paid to<br \/>\nKroll Associates, a UK-based investigation firm.<\/p>\n<p>The<br \/>\nappellants in their appeal aver that the Auditor General \u201ccommitted a grave and<br \/>\nfundamental error of law in purporting to investigate and make findings of<br \/>\nbreaches of the procurement law by the appellants when he had no such authority<br \/>\nat law.\u201d<\/p>\n<p><strong>Concern<\/strong><\/p>\n<p>The Majority<br \/>\nLeader and Minister of<br \/>\nParliamentary Affairs, Osei Kyei-Mensah-Bonsu, has equally expressed concern<br \/>\nabout how Mr. Domelevo is running Audit Service in the media.<\/p>\n<p>He<br \/>\nexpressed worry about the way the Auditor General makes his report public even<br \/>\nbefore it is presented to Parliament.<\/p>\n<p>\u201cIncreasingly, we are<br \/>\nfinding situations where the Auditor General, after they finish with the work<br \/>\nbefore they transmit it to Parliament, will organise press conferences and take<br \/>\nsome people to the cleaners,\u201d he pointed out.<\/p>\n<p>He,<br \/>\ntherefore, called on the Auditor General to make its report to Parliament for it to exercise effectively its power over the<br \/>\npurse. <\/p>\n<p>Mr. Kyei-Mensah-Bonsu<br \/>\nexpressed reservations about instances when the report of the Auditor General<br \/>\nwas presented to Parliament and it found out that the Auditor General got it<br \/>\nwrong and yet went out to make public its findings.<\/p>\n<p>\u201cIn many instances when the report has come to Parliament we find out that many times the Auditor General has gotten it wrong and yet he has gone out there to scandalise and vilify personalities,\u201d the Majority Leader said in Accra.<\/p>\n<p> <strong>BY Gibril Abdul Razak<\/strong> <\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Daniel Yaw Domelevo An Accra High Court has set aside the decision by the Auditor General, Daniel Domelevo, to disallow and surcharge a construction company based on its audit report.
