{"id":768680,"date":"2019-12-20T11:06:30","date_gmt":"2019-12-20T11:06:30","guid":{"rendered":"https:\/\/ghana-mma.com\/2019\/12\/20\/coup-plotters-file-for-bail-again\/"},"modified":"2019-12-20T11:06:30","modified_gmt":"2019-12-20T11:06:30","slug":"coup-plotters-file-for-bail-again","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/12\/20\/coup-plotters-file-for-bail-again\/","title":{"rendered":"\u2018Coup Plotters\u2019 File For Bail Again"},"content":{"rendered":"<p><\/p>\n<div>\n<p>The 10 persons arrested for allegedly plotting<br \/>\nto overthrow the government have filed another application seeking bail pending<br \/>\ntrial.<\/p>\n<p>The accused persons in their various<br \/>\napplications contended that it has been three months since their respective arrests<br \/>\nand subsequent arraignment but the police were yet to conclude their<br \/>\ninvestigations into the matter and, therefore, insisted that it amounted to<br \/>\nunreasonable delay.<\/p>\n<p><strong>Previous<br \/>\nAttempt <\/strong><\/p>\n<p>This is the second time lawyers for the accused<br \/>\npersons have attempted to secure bail for them pending the trial.<\/p>\n<p>Last month, an Accra High Court dismissed an<br \/>\napplication filed by seven of the accused persons as the court presided over by<br \/>\nJustice George Buadi held that they had been detained for less than two months<br \/>\nand that could not constitute unreasonable delays in the trial.<\/p>\n<p>ACP\/Dr. Benjamin Agordzo, a week later, also<br \/>\nfiled for an application for bail as his counsel Martin Kpebu argued that his<br \/>\nclient had no intention to carry out any coup in the country. <\/p>\n<p>That application was also dismissed by the same<br \/>\njudge, saying it was premature and held that the accused person, being a senior<br \/>\npolice officer, could interfere with investigations.<\/p>\n<p>The renewed bail applications are coming at a<br \/>\ntime the prosecution is preparing to send the case docket to the Office of the<br \/>\nAttorney General for advice.<\/p>\n<p><strong>Motion<\/strong><\/p>\n<p>Moving the motion for bail, private legal<br \/>\npractitioner, Victor Kwadzoga Adawudu, who represents seven of the accused<br \/>\npersons, told the court that it was strange that the prosecution after indicating<br \/>\nthat a 15-month surveillance led to the arrest of the accused person are still<br \/>\nsaying they are still investigating the matter.<\/p>\n<p>He said from the look of things, there is no<br \/>\ntime frame for the prosecution to conclude its investigations and, therefore,<br \/>\nurged the court to consider the grant of bail pending trial.<\/p>\n<p>He said the case had been unreasonably delayed<br \/>\nand, therefore, pleaded with the court to grant the accused person bail pending<br \/>\ntrial.<\/p>\n<p>He suggested that in the alternative, the<br \/>\nmilitary personnel among the accused persons be released to their unit<br \/>\ncommanders or the Provost Marshall who will produce them to stand trial at all<br \/>\ntimes.<\/p>\n<p><strong>Opposition<\/strong><\/p>\n<p>The application was opposed by Hilda Craig, a Senior<br \/>\nState Attorney, who said the accused persons are facing charges of abetment and<br \/>\ntreason felony which are serious offenses, and the investigations of such cases<br \/>\nare not as simple as the defence counsel was suggesting.<\/p>\n<p>She said most of the accused persons are<br \/>\nmilitary officers who would interfere with investigations and witnesses who are<br \/>\nmilitary personnel when granted bail.<\/p>\n<p>She added that looking at the charges and the number of accused persons involved, the<br \/>\ninvestigations will take a bit of time, and pleaded with the court to deny the<br \/>\naccused persons bail.<\/p>\n<p>The court presided over by Justice Georgina<br \/>\nMensah-Datsa adjourned the matter today to rule on the application.<\/p>\n<p>Lawyer for ACP Agordzo will also move his<br \/>\napplication for bail today.<\/p>\n<p><strong>Case<br \/>\nDocket<\/strong><\/p>\n<p>Meanwhile, a Kaneshie District Court has<br \/>\nadjourned the committal hearing involving the accused persons until January 8,<br \/>\n2020 after the prosecution led by ASP Sylvester Asare told the court that they<br \/>\nwere putting the case docket together to be forwarded to the Office of the<br \/>\nAttorney General for the preparation of the Bill of Indictment.<\/p>\n<p>The court presided over by Eleanor Barnes-Botchway advised the prosecution to speed up with investigations, hoping that by the time they return next year, the state would have made \u2018head way\u2019.<\/p>\n<p> <strong>BY Gibril Abdul Razak<\/strong> <\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The 10 persons arrested for allegedly plotting to overthrow the government have filed another application seeking bail pending trial.
