{"id":764404,"date":"2019-12-13T13:53:41","date_gmt":"2019-12-13T13:53:41","guid":{"rendered":"https:\/\/ghana-mma.com\/2019\/12\/13\/osafo-maafo-in-court-over-surcharge\/"},"modified":"2019-12-13T13:53:41","modified_gmt":"2019-12-13T13:53:41","slug":"osafo-maafo-in-court-over-surcharge","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/12\/13\/osafo-maafo-in-court-over-surcharge\/","title":{"rendered":"Osafo- Maafo In Court Over Surcharge"},"content":{"rendered":"<p><\/p>\n<div>\n<p> <strong>Yaw Osafo-Maafo <\/strong><\/p>\n<p>Senior Minister Yaw Osafo-Maafo has appealed against the decision of the Auditor General, Daniel Domelevo, to surcharge him and four others.<\/p>\n<p>According<br \/>\nto an appeal filed before an Accra High Court, the Senior Minister and the<br \/>\nother appellants are insisting that the Auditor General<br \/>\nacted \u201cunreasonably, capriciously and maliciously\u201d towards them in blatant<br \/>\nviolation of his duty as a public officer when he refused to inspect and study<br \/>\nthe evidence of work done by Kroll Associates UK Limited as requested by him (Osafo-Maafo).<\/p>\n<p>The<br \/>\nappeal is also challenging the investigations carried out by Mr. Domelevo as<br \/>\nthe Senior Minister suggested that the Auditor General does not have the powers<br \/>\nto investigate and make findings of breaches of the procurement law.<\/p>\n<p><strong>Genesis<\/strong><\/p>\n<p>The<br \/>\nAuditor-General has claimed that Mr. Osafo-Maafo and the Finance Ministry have<br \/>\ncolluded to pay the UK firm, Kroll and Associates Limited, $1 million for no<br \/>\nevidence of work done.<\/p>\n<p>The<br \/>\nUK firm in 2017 was contracted by the Senior Minister to recover assets from<br \/>\nidentified wrongdoers, among others.<\/p>\n<p>According<br \/>\nto the Senor Minister, the firm had done the work it was contracted to do and<br \/>\nthat there was enough evidence of work done.<\/p>\n<p>But<br \/>\nthe Auditor General later claimed that after audit, there was no evidence of<br \/>\nwork done by Kroll and Associates Limited and yet huge sums of money were paid<br \/>\nto the company.<\/p>\n<p>He<br \/>\nsubsequently imposed a disallowance and surcharge on the Senior Minister and<br \/>\nfour others involved in the contract.<\/p>\n<p><strong>Appeal<\/strong><\/p>\n<p>Not<br \/>\nsatisfied with the decision of the Auditor General to disallow and surcharge<br \/>\nhim and four others, the Senior Minister and has filed an appeal against the<br \/>\ndecision before an Accra High Court.<\/p>\n<p>Other<br \/>\nappellants include Michael Ayesu, Abraham Kofi Tawiah, Eva Asselba Mends, and<br \/>\nPatrick Nomo, all officers at the Ministry of Finance.<\/p>\n<p>The<br \/>\nappeal avers that the determination by the Auditor General that the payment of<br \/>\nGH\u00a24,869,421.87 without approval from Parliament and the Public Procurement<br \/>\nAuthority (PPA) and thus offended Article 181 of the Constitution violates the<br \/>\nappellants rights of hearing as same did not form part of either the audit<br \/>\nobservations issued to the Ministry of Finance or the final report of the<br \/>\nAuditor General laid before Parliament.<\/p>\n<p>It<br \/>\nsaid the Auditor General \u201ccommitted a grave and fundamental error of law in<br \/>\npurporting to investigate and make findings of breaches of the procurement law<br \/>\nby the appellants when he had no such authority at law.\u201d<\/p>\n<p>Some<br \/>\nof the errors of law committed by the Auditor General, according to the appeal,<br \/>\ninclude the claim that he is not vested with power to conduct\u00a0 investigations to establish procurement<br \/>\nbreaches, neither was he authorized by the PPA to carry out the purported<br \/>\ninvestigations relating to the alleged contraventions of the Procurement Act.<\/p>\n<p>It<br \/>\nalso adds that Article 2 (1) of the 1992 Constitutions requires a person who<br \/>\nalleges that an act or omission of any person in contravention of the<br \/>\nConstitution to bring an action in the Supreme Court for a declaration to that<br \/>\neffect.<\/p>\n<p>This,<br \/>\nthe appeal states the Auditor General failed to do but acted <em>SuoMotu <\/em>(acting on his own initiative)<br \/>\nto determine the constitutionality of an act.<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Yaw Osafo-Maafo Senior Minister Yaw Osafo-Maafo has appealed against the decision of the Auditor General, Daniel Domelevo, to surcharge him and four others.
