Kwadwo Boateng-Agyemang<\/strong><\/p>\n

The New Patriotic Party (NPP) Chairman for the
\nNew Juaben North Constituency in the Eastern Region, Kwadwo Boateng-Agyemang,
\nhas filed his statement of defence in a defamation suit against him and Adom FM
\ninitiated by a former Chief Executive Officer (CEO) of the Ghana Cocoa Board
\n(COCOBOD), Dr. Stephen Opuni.<\/p>\n

Mr. Boateng-Agyemang, in his defence statement,
\ndenied all the claims contained in Dr. Opuni\u2019s suit, stating that the plaintiff
\nwould be put to strict proof.<\/p>\n

It is the case of the NPP chairman that the
\ntranscription of the purported defamatory words for which he had been sent to
\ncourt was taken out of context and Dr. Opuni failed to analyse the full
\nstatement which would have placed it in context.<\/p>\n

Suit<\/strong><\/p>\n

The former COCOBOD boss
\nsued Mr. Boateng-Agyemang over allegations of embezzlement of $400 million when
\nhe headed the COCOBOD.<\/p>\n

Dr. Opuni is claiming the NPP chairman defamed
\nhim when he alleged that he (Opuni) withdrew the huge sums while he was in
\ncharge of the COCOBOD.<\/p>\n

Attached to the suit is Multimedia Group
\nLimited, operators of Adom TV, where the alleged defamatory statement was made.<\/p>\n

Defamation<\/strong><\/p>\n

Dr. Opuni, in his statement of claim, averred
\nthat the defendant on Adom TV\u2019s Badwan show stated that \u201cmeanwhile they have
\nspent all the money. As of 20th December 2016, Opuni withdrew almost $400
\nmillion \u2026 he claims he used part of the money to organize a press soiree and to
\nconstruct cocoa roads \u2026 I didn\u2019t know that in Ghana two years after constructing
\ncocoa roads, dwarfs are able to lift and take away the roads.\u201d<\/p>\n

This, according to the plaintiff, is understood
\nto mean that he illegally withdrew $400 million from the coffers of COCOBOD.<\/p>\n

Dr. Opuni is seeking general damages as well as
\nexemplary damages of GH\u00a220 million against the defendants, a retraction and
\napology on Adom TV and its online platform with the same prominence given to
\nthe alleged defamatory statement.<\/p>\n

Defence<\/strong><\/p>\n

But Mr. Boateng-Agyemang, in his statement of
\ndefence, has said his comment was fair and speaks to the facts of issues
\nhappening in the country.<\/p>\n

According to him, the interpretation of his
\nwords and the innuendo alluded to by Dr. Opuni were \u201cmisplaced, over stretched
\nand ill-fitted in the context in which the defendant spoke.\u201d<\/p>\n

He said his discussions on the programme
\nrelated to what government had done better in the cocoa sector, and he gave a
\nhistoric performance of successive governments and concluded that the
\nAkufo-Addo government had done remarkably well compared to previous ones.<\/p>\n

He avers that Dr. Opuni is not entitled to any of his claims as the instant suit is a calculated attempt to gag him from speaking on matters relating to Dr. Opuni\u2019s time at COCOBOD.<\/p>\n
