Court Affirms Afoko Bail Revocation"},"content":{"rendered":"<p><\/p>\n<div>\n<p> <strong>Gregory Afoko <\/strong><\/p>\n<p>The<br \/>\nSupreme Court on Tuesday upheld the decision of an Accra High Court to rescind<br \/>\nthe bail granted Gregory Afoko, the prime suspect in the murder of the late<br \/>\nUpper East Regional Chairman of the New Patriotic Party (NPP), Adams Mahama.<\/p>\n<p>A<br \/>\nfive-member panel held that the judge did not err in revoking the bail which<br \/>\nwas granted Afoko by another court in March.<\/p>\n<p>The<br \/>\ncourt presided over by Justice Jones Victor Dotse and assisted by Justices Yaw<br \/>\nApau, Gabriel Pwamang, Samuel Marful-Sau and Prof. Nii Ashie Kotey subsequently<br \/>\ndismissed an application by Afoko that was seeking an order to quash the decision<br \/>\nof the High Court.<\/p>\n<p><strong>Initial Bail<\/strong><\/p>\n<p>An<br \/>\nAccra High Court presided over by Justice George Buadi in March granted Afoko<br \/>\nbail of GH\u00a2500,000 with two sureties, one to be justified.<\/p>\n<p>The<br \/>\ncourt further ordered the accused person to report himself once every two weeks<br \/>\nto the Criminal Investigations Department (CID) at the Police Headquarters in<br \/>\nAccra.<\/p>\n<p>This<br \/>\nwas after the Attorney General had entered nolle prosequi to discontinue Afoko\u2019s<br \/>\ntrial following the arrest of another suspect in the matter, Asabke Alangdi.<\/p>\n<p>The<br \/>\ntwo have since been committed by a District Court to stand trial again at the<br \/>\nHigh Court on two counts of conspiracy and murder.<\/p>\n<p><strong>Overturned Decision<\/strong><\/p>\n<p>The<br \/>\nbail was, however, rescinded by an Accra High Court presided over by Justice<br \/>\nMerley Wood, a Court of Appeal judge, when the accused persons were put before<br \/>\nher.<\/p>\n<p>This<br \/>\nfollowed an oral application by Marina Appiah Opare, a Chief State Attorney,<br \/>\nwho said the other court granted Afoko bail on the grounds that his trial was<br \/>\nyet to commence and the republic was uncertain as to when the trial would begin<br \/>\nand that he had been in custody without trial since his arrest.<\/p>\n<p>Afoko\u2019s<br \/>\nlawyers opposed the prosecution\u2019s request, saying the court which granted the<br \/>\napplication for bail had taken into consideration all the issues and said the<br \/>\nstate could not allege that Afoko was a flight risk but the court rejected the<br \/>\nargument.<\/p>\n<p><strong>Certiorari Application<\/strong><\/p>\n<p>Not<br \/>\nsatisfied, Afoko filed an application at the Supreme Court seeking an order to<br \/>\nquash the revocation of his bail and also to prohibit the judge from hearing<br \/>\nthe case.<\/p>\n<p>Moving<br \/>\nthe application, his lawyer Osafo Buabeng argued that the mere filing of a nolle<br \/>\nprosequi by the AG did not terminate the trial and insisted that the accused<br \/>\nperson ought to have been brought before the trial court for him to be<br \/>\ndischarged.<\/p>\n<p>He<br \/>\nsaid since he was not discharged, it implied that the first trial was still<br \/>\nongoing and, therefore, could not be put before another court based on the same<br \/>\ncharges.<\/p>\n<p><strong>AG\u2019s Opposition<\/strong><\/p>\n<p>The<br \/>\napplication was opposed by the Deputy Attorney General, Godfred Yeboah Dame,<br \/>\nwho said once nolle prosequi is entered, it automatically terminates the<br \/>\nongoing trial.<\/p>\n<p>He<br \/>\nadded that it is not true that one High Court had granted bail and another had<br \/>\nrevoked it, arguing that there is only one High Court with several divisions.<\/p>\n<p><strong>Judge<\/strong><\/p>\n<p>Justice<br \/>\nPwamang interjected and said when bail is granted an accused person during a<br \/>\ncommittal proceeding, the bail ceases to exist.<\/p>\n<p>Besides,<br \/>\nhe said once the accused person is committed for trial, it becomes the<br \/>\ndiscretion of the trial judge to maintain the bail or remand the accused<br \/>\nperson.<\/p>\n<p><strong>Ruling<\/strong><\/p>\n<p>The panel then dismissed the application, saying \u201cit has
