{"id":753931,"date":"2019-11-28T11:54:24","date_gmt":"2019-11-28T11:54:24","guid":{"rendered":"https:\/\/ghana-mma.com\/2019\/11\/28\/supreme-court-dismisses-nana-contempt-case\/"},"modified":"2019-11-28T11:54:24","modified_gmt":"2019-11-28T11:54:24","slug":"supreme-court-dismisses-nana-contempt-case","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/11\/28\/supreme-court-dismisses-nana-contempt-case\/","title":{"rendered":"Supreme Court Dismisses Nana Contempt Case"},"content":{"rendered":"<p><\/p>\n<div>\n<p> <strong>Bright Akwetey <\/strong><\/p>\n<p>The<br \/>\nSupreme Court yesterday dismissed an application for contempt brought against<br \/>\nPresident Akufo-Addo over the much-talked-about National Cathedral project.<\/p>\n<p>The<br \/>\ncontempt action was initiated by a man called Jonathan Holm who is represented<br \/>\nby Bright Akwetey. The court described the application as incompetent and<br \/>\nwithout merit.<\/p>\n<p>A<br \/>\nseven-member panel chaired by Justice Jones Victor Dotse while dismissing the<br \/>\napplication said the President is immune from both criminal and civil actions<br \/>\nas stipulated by Article 57 (4 and 5) of the 1992 Constitution.<\/p>\n<p>The<br \/>\ncourt went ahead to explain that the same constitution while giving the President<br \/>\nimmunity also prescribed solutions on how to deal with him<br \/>\nin the form of impeachment.<\/p>\n<p>Moving<br \/>\nthe motion on notice, Mr. Akwetey insisted that even though Article 57 stipulates<br \/>\nthat the President cannot be sued while in office, he could still be sued when<br \/>\nhe is personally liable for a crime.<\/p>\n<p>According<br \/>\nto him, when the President \u2018deliberately\u2019 commits a crime, he is open to legal<br \/>\naction and urged the court to commit the President for contempt.<\/p>\n<p><strong>Preliminary Objection<\/strong><\/p>\n<p>Dorothy<br \/>\nAfriyie Ansah, a Chief State Attorney, raised a preliminary objection insisting<br \/>\nthe President is immune from both criminal and civil actions as per Article 57<br \/>\n(4 and 5) as a sitting President.<\/p>\n<p>She<br \/>\nargued that the President can only be sued three years after leaving office as<br \/>\nthe Constitution mandates, and urged the court not to entertain the<br \/>\napplication.<\/p>\n<p>In<br \/>\nthe main suit, the plaintiff is pushing that the President\u2019s pledge and<br \/>\nsubsequent decision to build a National Cathedral is in fulfilment of his<br \/>\nprivate pledge.<\/p>\n<p>He<br \/>\nalso argued that the use of the state land to build the National Cathedral is<br \/>\nunconstitutional because he said it does not serve any interest of the public.<\/p>\n<p>He, therefore, wants \u201ca declaration that the land designated by the President of the Republic for the construction of the National Cathedral was compulsorily acquired under Section 3 of the Public Lands Ordinance of 1876 (Cap. 134).\u201d<\/p>\n<p> <strong>By Gibril Abdul Razak<\/strong> <\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Bright Akwetey The Supreme Court yesterday dismissed an application for contempt brought against President Akufo-Addo over the much-talked-about National Cathedral project.
