AN
\nAPPLICATION for injunction filed by owners of the defunct uniBank to prevent
\nNii Amanor Dodoo, Receiver for Unibank, from taking over a property of the bank
\nat East Ridge, Accra, was on Friday dismissed by an Accra High Court.<\/p>\n
The office
\nbuilding located at East Ridge is currently occupied by Topp Core Security
\nLimited. <\/p>\n
The receiver
\nis said to have served the occupants of the building a notice to vacate the
\nproperty. But the former owners of the bank challenged the decision and took
\nthe issue to court praying that the receiver should be prevented from evicting
\nthe tenants.<\/p>\n
The court
\npresided by Eric K. Baffuor, however, ruled that the applicants did not
\ndemonstrate sufficiently how the receiver\u2019s decision to evict the occupant of
\nthe property would affect the owners particularly since the tenant has not also
\nprotested the eviction notice.<\/p>\n
Mr. Dodoo has
\nsince his appointment as receiver for the bank been working hard to retrieve
\nand preserve all assets of the defunct bank.<\/p>\n
Mr.\u00a0 Dodoo\u2019s pursuit of taking over properties of
\nthe former bank as the receiver is supported by the Banks and Specialised
\nDeposit-Taking Act, 2016 (Act 930). <\/p>\n
According to
\nJustice Baffuor, even though there was an ongoing arbitration on the revocation
\nof uniBank\u2019s licence, the receiver was not party to that and could not be
\nprevented from performing his functions of preserving assets that legally
\nbelonged to uniBank.<\/p>\n
He stated
\nthat in the event that the arbitration was successful, the asset would revert
\nto uniBank as the receiver was only acting on behalf of the former owners and
\ndirectors of uniBank adding that the bank would be the ultimate beneficiary.<\/p>\n
The court
\nruling on Friday is expected to empower Mr. Dodoo, who is also receiver for the
\nConstruction Bank, The Royal Bank, Beige Bank and Sovereign Bank, to take over
