{"id":726240,"date":"2019-10-18T12:04:03","date_gmt":"2019-10-18T12:04:03","guid":{"rendered":"https:\/\/ghana-mma.com\/2019\/10\/18\/ofosu-ampofo-fights-leaked-tape\/"},"modified":"2019-10-18T12:04:03","modified_gmt":"2019-10-18T12:04:03","slug":"ofosu-ampofo-fights-leaked-tape","status":"publish","type":"post","link":"https:\/\/www.ghanamma.com\/2019\/10\/18\/ofosu-ampofo-fights-leaked-tape\/","title":{"rendered":"Ofosu-Ampofo Fights Leaked Tape &#8211;"},"content":{"rendered":"<p><\/p>\n<div>\n<p><strong>Samuel Ofosu-Ampofo <\/strong><\/p>\n<p>The embattled National Chairman of the opposition National Democratic Congress (NDC), Samuel Ofosu-Ampofo, has renewed attempts to have the charges against him over a leaked tape thrown out of court.<\/p>\n<p>His lawyers have<br \/>\nfiled an application before an Accra High Court, hearing his case to challenge<br \/>\nthe \u2018constitutionality\u2019 of the audio recording which led to his arrest and subsequent<br \/>\narraignment.<\/p>\n<p>Ofosu-Ampofo and<br \/>\nthe party\u2019s Deputy Communications Officer, Anthony Kwaku Boahen, have been<br \/>\ncharged in respect of the leaked tape which captured how the NDC is allegedly<br \/>\nplanning to commit crimes in the country and turn round to blame them on the<br \/>\nruling New Patriotic Party (NPP).<\/p>\n<p>The alleged<br \/>\nleaked tape is among a list of documents filed by the Attorney General\u2019s (AG\u2019s)<br \/>\nDepartment for the trial of the two NDC top officials.<\/p>\n<p>His lawyers are<br \/>\nnow challenging the \u2018authenticity\u2019 and \u2018constitutionality\u2019 of the tape which<br \/>\nthe prosecution intends to rely on for his trial.<\/p>\n<p>The application<br \/>\nwhich is scheduled to be heard on November 4, 2019 is questioning how the audio<br \/>\nwas obtained and the fact that it infringes on the constitutional right of Mr.<br \/>\nOfosu-Ampofo.<\/p>\n<p><strong>Earlier Application<\/strong><\/p>\n<p>This is not the<br \/>\nfirst time his lawyers have tried to have the charges against him dropped and<br \/>\nthe trial stopped.<\/p>\n<p>His lawyers at<br \/>\nthe beginning of the trial filed an application to strike out the two charges<br \/>\nof assault against a public officer.<\/p>\n<p>His lawyers<br \/>\nargued that failure by the AG to provide particulars of the charges constitutes<br \/>\na \u2018defect\u2019 and, therefore, he cannot be called to answer to them.<\/p>\n<p>The Director of<br \/>\nPublic Prosecution, Yvonne Atakora-Obuobisa, however, opposed the application<br \/>\nand urged the court to disregard it.<\/p>\n<p>The presiding Judge,<br \/>\nJustice Samuel K. Asiedu, dismissed the application on the grounds that the<br \/>\ncharges were valid and the defect, as stated by the lawyer, was not fatal to<br \/>\nthe trial.<\/p>\n<p><strong>Stay Proceedings<\/strong><\/p>\n<p>Meanwhile, his lawyers<br \/>\nhave filed a repeat application for stay of proceedings at the Court of Appeal,<br \/>\npending the determination of an appeal against the judge\u2019s decision to dismiss<br \/>\ntheir earlier application for stay of proceedings.<\/p>\n<p>Tony Lithur, who<br \/>\nrepresents Ofosu-Ampofo, on July 30 moved a motion urging the court to stay its<br \/>\nproceedings while they appeal the trial court\u2019s ruling.<\/p>\n<p>He told the<br \/>\ncourt that there were exceptional circumstances for which the court should stay<br \/>\nits proceedings. <\/p>\n<p>He averred that<br \/>\nthe court was enjoined to protect fundamental human rights; one which he said<br \/>\nincluded protection against \u201coppressive criminal charges\u201d being perpetrated by<br \/>\nthe state against the NDC gurus.<\/p>\n<p>He, therefore, said<br \/>\nthe court should stay its proceedings to allow them to argue their case before<br \/>\nthe Court of Appeal.<\/p>\n<p><strong>Opposition<\/strong><\/p>\n<p>The state represented<br \/>\nby Asiama Sampong, a Chief State Attorney, opposed the application saying it<br \/>\ndid not raise any special circumstances for which the proceedings should be<br \/>\nstayed. <\/p>\n<p>He said the<br \/>\nissue of the protection of the fundamental human rights of the accused person<br \/>\nwould be dealt with during the trial and prayed the court<br \/>\nto refuse the application. <\/p>\n<p>Mr. Sampong<br \/>\ndescribed the application as frivolous and an abuse of the court process. <\/p>\n<p>The trial Judge,<br \/>\nJustice Asiedu, dismissed the application and adjourned the case to October 17<br \/>\nfor continuation.
