Martin A.B.K. Amidu <\/strong><\/p>\nSpecial Prosecutor Martin A.B.K. Amidu and Deputy Attorney General
\nGodfred Yeboah were yesterday caught in crossfire over efforts to enforce a
\nSupreme Court order that says it should retrieve 47 million Euros fraudulently
\npaid to Waterville Holdings (BVI) Limited \u2014 a
\ncompany belonging to businessman Alfred Agbesi Woyome and others.<\/p>\n
While Mr. Amidu blames the Office of the Attorney
\nGeneral for \u2018dragging\u2019 its feet in retrieving the 47 million Euros, the Deputy
\nAttorney General (AG) in turn accused the Special Prosecutor over his refusal
\nto supply the AG with confidential documents that would help them trace the
\ncompany to retrieve the judgment debt.<\/p>\n
Mr. Amidu has consistently stated that he has
\ninformation that could help the AG trace the company to retrieve the money but said
\nit would be suicidal to hand over the information to the AG.<\/p>\n
Main
\nSuit<\/strong><\/p>\nHe filed a suit at the Supreme Court in
\nSeptember asking the court to \u2018compel the AG to enforce an order and retrieve
\nthe money wrongfully paid to the company\u2019.<\/p>\n
According to the suit, unless the court
\n\u2018compels\u2019 the AG to enforce the order and also Woyme\u2019s company is ordered to
\ncomply and pay the full amount of debt, the labour and expenses exerted by him
\nas the plaintiff on behalf of Ghanaians would go in vain.<\/p>\n

\nDebt<\/strong><\/p>\nThe Supreme Court on June 14, 2013 ordered
\nWaterville Holdings (BVI) Ltd to refund all monies paid to it by the National
\nDemocratic Congress (NDC) government as judgment debt over the termination of
\nan \u2018illegally\u2019 awarded contract for rehabilitation works on the Accra Sports
\nStadium for the AFCON 2008 hosted by Ghana.<\/p>\n
The Office of the AG under the John Mahama
\nadministration was, however, reluctant to retrieve the debt and subsequently
\ndelayed the processes of seeking direction from the court regarding the
\nenforcement of the orders.<\/p>\n
International
\nCourt<\/strong><\/p>\nWoyome then instituted an action at the
\nInternational Court of Arbitration against the Government of Ghana, challenging
\nthe decision of the Supreme Court for his company to refund the money.<\/p>\n
Mr. Amidu then went to the Supreme Court in
\nSeptember seeking an order for the AG to enforce the original order for Woyome
\nto refund the full amount of \u20ac47,365,624.00 (excluding interest thereon).<\/p>\n
According to him, it has been more than a year
\nsince the Arbitration Tribunal brought the arbitration proceedings to an end
\nand although the ruling is in favour of Ghana, the Supreme Court\u2019s orders are
\nyet to be enforced.<\/p>\n

\nExchanges<\/strong><\/p>\nAppearing before the court yesterday, he told
\nthe court that he commenced the action to ensure that the orders of the court
\nwere enforced.<\/p>\n
He claimed to have information on Waterville
\nHoldings, saying he had confronted the government about how to retrieve the
\nmoney but nothing seems to have happened.<\/p>\n
He said it had been several years since the
\njudgment was entered in favour of the state and that he was before the court to
\nassist it to ensure that the judgment is enforced so that the people of Ghana
\nwill have the benefit of the judgment.<\/p>\n
Dame
\nArgument<\/strong><\/p>\nMr. Dame opposed the application saying it was \u2018laden\u2019
\nwith procedural improprieties and urged the court to dismiss it.<\/p>\n
He said although Mr. Amidu claims to have
\napproached the government, at no point did he write to the AG who is charged
\nwith the responsibility to retrieve the money.<\/p>\n
According to him, the AG was having difficulty in
\nlocating and identifying the assets of Waterville Holdings in Europe, if any.<\/p>\n
He told the court that Mr. Amidu, who seems to
\nhave information about the company, was unwilling to churn out the information,
\n\u201ceven this morning I asked him for the information but he said he would not
\ngive it to me.\u201d<\/p>\n
Judges<\/strong><\/p>\nThe panel of judges raised concerns about the
\nnature of applications filed by Mr. Amidu, as they were not clear as to what he
\nwas seeking.<\/p>\n
Justice Sule Gbadegbe noted that once an order
\nis made by a court, the order becomes binding and there is no need for a
\nfurther order to enforce the previous one.<\/p>\n
Justice Paul Baffoe-Bonnie also stated that the
\norder of the court was that the money was illegally paid to Waterville hence it
\nhad to refund the money which meant that the AG was directed to retrieve the
\nmoney and as a result there is no need for another order.<\/p>\n
Important
\nQuestion<\/strong><\/p>\nHe asked Mr. Amidu why he would
\nnot cooperate with the AG with the information at his disposal so that together
\nthey can trace the company and ensure the money was retrieved.<\/p>\n
Mr. Amidu initially said it would be \u201csuicidal
\nto do so\u201d but later prayed for some time to consult the AG so they could see
\nhow they would use the information he has to trace the company.<\/p>\n
The court presided over by Justice Paul Baffoe-Bonnie and assisted by Justices Sule Gbadegbe, Alfred Benin, Samuel Marful-Sau and Agnes Dordzie gave Mr. Amidu and the AG three weeks to do so.<\/p>\n
